Town orders man to take down zombie nativity scene

An Ohio homeowner was ordered by town officials to remove a Nativity scene in front of his house that featured zombies instead of wise men and a baby Jesus.

The Nativity scene features life-size figures and a zombie baby Jesus, with pale skin and pure white eyes. At night, the figures are illuminated by red and green lights.

According to documents obtained by Fox 19, Sycamore Township, which is outside Cincinnati, does not allow structures to be located in the front or the side yard to occupy more than 35 percent of the area. Also, the primary structure must be 3 feet from the street, and 6 feet from the house.

"I've lived here for 15 years and I've never had a violation of any kind," Dixon said. "It's a holiday decoration. I know if it was a real pretty Nativity scene they wouldn't be saying anything."

Seems like the town is digging through the books to find a law he broke. He has until the 26th to remove it, so it can stay up through the holidays.

He's practicing his 1st Amendment rights. And personally, it doesn't look any more offensive than than most of the dilapidated buildings in Cincinnati (last time I was there anyway - I can't imagine the area has improved much).

If you read the story, you'd know that they didn't accuse him of being offensive, but that he (apparently) ran afoul of several regulations. Odds are if his display was a regular nativity scene nobody would have looking into the regs (and his adherence to them) very closely, but they did, and he is in violation. If he puts up the same nativity scene again but this time adhering to whatever code/regulations exist there, he's in the clear.

Pretty much so.
Granted, I love living in an area that has HOA guidelines. It keeps the area neater, safer, and property values stay relatively high. But it can be a real pain in the ass when hypocritical double standards are upheld (such as the case here).
