So I was driving home with an adventure seeking friend of mine today from midgetville, (seriously) and we began talking up plans for the summer. One of the big things we have always wanted to do is check out some of the places where pirate gold was said to be buried and never found. Which led to us arguing over the following, so any advice would be appreciate:

On the off chance we found anything:
Would we get to keep it with todays legal standards, or would it go to whoever owned the land we found it on?

What if its public land (the beach)?

What if it is a state park?

What if it is on someone else's property, (in a chance where we find it, but no house or anything is there, but someone legally owns the title to the land?)

Are we even legally obligated to say where we found it? Could we just refuse to say?

I know we have no chance of finding anything, I just really was wondering the answers to these questions, hopefully some atot lawyers can help!

Personally, I'd just not tell anyone where I found it and then re-bury it where I have the rest of my booty.

I am not 100% sure but I think you have to get a treasure hunting license of sorts (not joking) and even then a certain % goes to the government.

Also is this in the US or international waters?

Its called a salvage license, and you need it to resurface sunken ships.
If you are just digging on lost islands, I dont think you need anyhting like that.

IANAL: People have found treasure while using metal detectors on public land and been able to keep it. If you take it from private land I bet it is considered stealing. If you remember the T.Rex "Sue" was found on private land by a scholar, but was auctioned off by the land owner. http://www.cnn.com/TECH/9710/04/dino.bones/

I think it varies state to state. Used to work for DHR of Florida and they basically had all sorts of treasure hunters calling and saying they "found some item" and wanted to "sell it" to the state....but.....its the states property and items buried within that are found are the states property

i can't imagine there are too many lost islands left these days. i don't think he's planning on sailing any uncharted waters or anything.
