yeah i hate that rule, i have seen it numerous times when players take off their helmets and it doesnt get called...

its like holding it seems, its only when the refs feel like calling it

The Raiders have one of the most inept special teams I've ever seen. How much do these morons get paid?

And, yes, Sapp should have been flagged for taking his helmet off. A ref might argue that it wasn't clear that a hold took place but I don't see how any ref could say with a straight face that he didn't see Sapp take his helmet off.
