I agree with your third point, but that is exactly the problem. This is a pretty clear cut case that no one would think would ever get to the USSC if it was about anyone else. But here we are having to wonder if the USSC will once again step in to delay for Trump.

And I think this is a perfect example for the argument. We have a current president trying to defend the secrets and intelligent sources of the country and a Judge is arguing that the former president should have more say in that decision than the current President based on some "executive privilege".
