That's a very telling picture that clearly shows documents marked "top secret" on what I assume is Trumps carpet. They caught the orange man red handed.
Lets get on with the charges, the arrest, and the trial. I'm 100% behind that course of action and there is no circumstances under which it should be delayed by a single day. I don't understand why Trump isn't in custody right now.

I think there is clearly enough evidence for a complaint to lead to a federal arrest warrant.

That said, I'm not entirely sure how precedent would actually typically follow in a case like this. If it is believed that all materials have been collected and that the subject is not an immediate flight risk prior to indictment, it does make some sense to ensure that the documents have been properly filtered, that any legal challenge to the search / request for special master be decided, and for a grand jury to hear the evidence and secure an indictment before making an arrest.

We've seen the political backlash of the FBI search already. Imagine how the country would explode if Trump were behind bars at this moment. I very much find this compelling reason to have all the t's crossed and i's dotted prior to arrest.

DoJ's filing makes another good point. If Trump is now claiming that he de-classified those documents, why was this claim not made in response to correspondence from NARA, as well as the DoJ subpoena? They repeatedly alleged that they believed Trump had taken classified documents. That would have been the time to assert that claim. If he is going to try that defense at trial, I doubt any jury will believe him.

DoJ also making an argument about standing ... I think that's the most troubling hurdle for whatever lawyers Trump hired out of craigslist.

And that pic of the TS/SCI document covers is utterly damning.

If Trump is now claiming that he de-classified those documents, why was this claim not made in response to correspondence from NARA, as well as the DoJ subpoena? They repeatedly alleged that they believed Trump had taken classified documents. That would have been the time to assert that claim. If he is going to try that defense at trial, I doubt any jury will believe him.

I think most of the potential charges so far don't even require the documents being classified. Even if he did declassify them (which I don't think he did), the actual documents would still be government property, which he took, hid and lied about.

Edit: I also think the wording of the subpoena boxes him in more. The subpoena from the Grand Jury asked for all documents that bore "classification markings". At a minimum, they have him and probably his attorney's dead to rights for obstruction given those classification markings in those pics. seem hard to miss.

Yeah ignoring the presidential records act is only 3 years. And that was why NARA was handling it from after Jan 2021 to May of this year. Now it's jumped to espionage

I would expect eventually overwhelming evidence to take hold. At least we could get an explanation from anyone of those 12 people. I would love to hear it.

Hopefully none of those people will ever serve on a jury.

I think whether the documents were classified or not is hugely important though. He'll do way more time if the docs were classified. And poliically speaking, the prosecution will look petty if it is entirely over unclassified records.

Sadly i dont think there is such a think as overwhelming evidence for Trump supports. They will just claim it was all planted by the FBI as a witch hunt. Oh wait...theyve already done that. They will stick to their guns.

If the Trumps were to leave, great. I'd love the old toad to rot his last days away in prison, but I don't have any real hopes that will happen no matter what he did. He was right when he said he could kill someone on the street on 5th avenue and get away with it.

Go live out your worthless life in some resort somewhere, posting memes on your social network until it gets closed down--just as long as you aren't near public office again, this is a major win.

BS!!! Only Repugnicans are making this political. Only idiots can both sides this with Hillary

It's not going to play well with swing voters if all this is somehow ruled as unclassified presidential records. It's going to seem like a tempest in a teapot. The fact that some of these materials are highly classified is where all the political juice is. I also doubt Trump would get any serious time for improperly retaining unclassified materials.

Trump's passports were reportedly returned. Why and where would he flee to? And would Melania and his children want to go with him?

Trump may think he's going to be reinstated by his supporters.
