I think it has gone unnoticed that the thing Trump is appealing will have little to no effect on the criminal case against him even if SCOTUS ruled in his favor.
Wouldn't they have just done that then instead of asking the DOJ for a response? That makes it sound like they are going to give a ruling.They aren't going to rule in his favor on this. You may even see a one paragraph statement which is a refusal to hear the case. Like we saw with the two election conspiracy cases that went to the SCOTUS in 2020.
