It sounds like they are going for the claim that because trump reimbursed him that it wasn't a campaign contribution. Stormys lawyer says there are a couple of potential problems with this. If the payments were made under a certain amount to avoid scrutiny then they may still be illegal. If trump didn't pay interest on the payments, it may still be considered a campaign contribution.

Based on rudy's statement we do know that trump, of course, was lying.

I doubt that it was listed as a campaign expenditure... And besides that, paying her off 10 years later right before the election had nothing to do with the campaign, right?

Yep, it must be disclosed and if he made payments to stay under the legal requirement that too would be illegal as well.

Why he did it wouldn’t matter. As the candidate he can contribute unlimited funds into his own campaign. What exposed Cohen was doing it so close to the election as it could be seen as a contribution. For Trump it would be irrelevant.

An expenditure filing issue by the president is a lot different than an in kind contribution by Cohen. Sure throws Cohen a bone though doesn’t it?

Sure. If it is related to the campaign. Which let’s face it that close it probably was. But they could argue it’s also a normal course of business. Preserving reputation, preventing his wife from finding out about the affair blah blah blah. That would be up for the FEC to decide.

But an improper expenditure filing is a lot better for Cohen than a contribution of $130,000 and by taking the bullet on this one sends a message to Cohen that Trump still has his back for anything else that might be in the background we don’t know about yet.
