Sounds like NY is single party. But Kent Starr already got illegal phone recordings used against a president, so the precedent has been set by republicans.

I'm still trying to wrap my head around one thing:

- Special Master deems this recording discussing payment to Karen MacDougall IS in fact priveleged...
- That means prosecutors in Cohen case don't get to use it...
- But then Trump's legal team leaks existence of said recording to the press...
-...and Giuliani waives privelege by discussing the contents
- So now prosecutors can use it??

Basically, Trump's lawyers leaked it, either to a) screw Cohen over and remove leverage for cutting a deal; or b) get this over and done with in the news cycle (also distracts from treason with Russia?)

Still, doesn't this feel like an own goal??

Well, they're backing their guy. Nixon had many upstanding politician on his side of the aisle turn their backs on him because it was the right thing to do. That's not happening here. So in that regard they're doing it right.

Correct. It seems likely that Trump's legal team first leaked it to create a buzz & use it as a character attack against Cohen. Rudy's running a PR campaign, not a legal defense because this will end up in Congress before it ever ends up in court.

Something else that someone pointed out on Twitter... Trump's lawyers only got a look at the tape after Cohen's lawyers decided to share it. That means their defense teams were still cooperating...ergo Cohen hadn't flipped yet at the time.

That's not correct. The Special master first culls out anything confidential between Cohen & any other clients. From there it goes to Trump's lawyers & Cohen's lawyers who argue that some stuff deemed non-confidential really is which the court usually rejects. Each acts to preserve their client's privilege.The non-confidential stuff goes to the govt. Both intervenors are entitled to all the same stuff by order of the court.
