Because, being involved with a hit and run while under the influence of drugs and alcohol is going to look a lot worse than simple possession of weed and fleeing (and coming back when sober).
Not in my mind and I am assuring you not in the minds of many of those who are watching. Drugs can be personal problems or lapse in judgement but leaving the crime like that indicates lack of any character or integrity at all. Basically drugs gives him an opportunity to say look I am not that soulless but drugs were clouding my mind. That would make it possible for him to not go to jail but instead get major rehabilitation.
