Say you had a really bad stepping of cpu. One that really was only stable around stock speeds, it works fine, but you just like to overclock.

Would it be so bad to purchase another of the same chip at some retail outlet, and then return your underperforming chip?

Someone has to have done this, speak up!

Yes, people do it.

No, it is not OK and it is, most likely, illegal.

(And may you burn in hell for speaking of this in public.)

Enjoy your 15-20% restocking fee.

If you "accidentally" break it and return it, enjoy that wonderful feeling of knowing that you've just defrauded a store, and are responsible for raising their costs, and thus prices.

Yes, it's bad. You bought a chip rated to do X. It does X. You returning it because it doesn't do X+Y is, at a minimum, not cool, and is 99% of the reason retailers have craptastic return policies.

your underperforming chip?

It's not underperforming, jackass - it performs as advertised.

the correct way to do this is to sell the chip you don't like on FS/T and buy a new chip

It would be fraud, and it is illegal. It is up to your own moral compass to decide if this is "bad or not", but the law is clear.

You said it was stable at stock speeds then said it was an underperforming chip?

the only legit thing to do is sell it on ebay or on the for sale forums noting it has a bad stepping, and hoping to get close enough to the cost of a new one so you can buy it.

Morally? Depends on your moral compass. You clearly want to do it, so your morality appears to have taken a backseat to your lust for overclocking.

Legally? Wrong. Phail. No, can't has. Not yours.

It's pretty clear: you want to do it, even though you know it's wrong (at least in the eyes of the law). I figure you're going to do it anyway though, so enjoy. Or something.

This is a classic "if you have to ask" question.

Yes, you can do it.
Yes, many people do it
Yes, you will likely get away with it.

also...

Yes, you are a scumbag
Yes, you are probably violating the law but fsck if I know which one
Yes, you already know you are wrong, so why ask?
