Probably from the very beginning.

I am still convinced the governor or somebody pressured them into murder one when they knew damn well all they had was aggravated assault. Why do you think they pulled up useless witnesses like the girl and his parents? They tried using emotion and had very little evidence.
It was a mess on day 1 and got worse as the media started to salivate.

This whole incident has been more about the media and american culture than a working of the legal system.

The press needs to milk this as long as possible so sponsors will pay them top dollar.
From this point on we are going to hear opinions from political groups, the man on the street, "experts" working in journalism, shrinks, loud mouthed talk show hosts, analysts of every type.
This will go on for a good month at least.

1. Family isn't liable, Martins estate would be.
2. Damages for the assault would be his medical expenses
