If they are illegals, that's typical. It may not even be their address. Maybe a relative's or a friend's or something. I'll stop there, because we don't want to make it an anti-illegal thread

Thats what I was trying to avoid, and I didnt even mention it in the first post. Although it definetely has a bearing on the situation. Its hard to mention it without sounding racist.

There's nothing racist about it. Illegals (of all races) are a drain on our country economically and lead to situations like this.

I agree, but you know how touchy people get when you get on the subject of illegals. You are more in tune with whats going on because you live in Phoenix too, but people from other states may not understand.

And to believe some people want to make it easier for illegals to get driver's liscenses...

Get Uninsured Motorist and Underinsured Motorist coverage on your policy. I live in Phoenix and go with Progressive, part of my 6 month policy:

UNINSURED MOTORIST $13.00
$25,000 EACH PERSON - $50,000 EACH ACCIDENT
UNDERINSURED MOTORIST $5.00
$25,000 EACH PERSON - $50,000 EACH ACCIDENT

$18 every six months and I'm covered. It's worth $3 a month.

QFT!!!

With these coverage you get paid and the insurance company will (if they decide to) sue to recover their losses. They then handle the lawsuit and expense, not you.

Word, its on all of my cars, its a no brainer

wow i didn't know people actually chose to NOT carry this! it's so cheap... I was in an accident back in '98 with someone who had no insurance and it was entirely their fault. My insurance company paid all medical bills and pain and suffering, etc. and I had to sign something saying if my insurance company decided to take action against the person I hit I would testify.

I talked to my dad (who is the owner of the insurance) and he wasnt aware that uninsured driver was NOT included. It's his fault for not being aware but it sure is unfortunate that not realizing a stupid thing like that will leave him out of 8 grand.

Basically what happened was a young girl in a camaro hit my brother's audi. She messed up, he was at the wrong place at the wrong time and his car is now totalled. His arm is beat up from the air bag but he's OK. His car was a '99 A4 with some aftermarket stuff, we managed to pull the stereo out before it was towed. He loved that car to death.

We just found out that their insurance went out THE DAY BEFORE the accident, and now my brother is screwed. So my first question is, is there anything that can be done about this? From what we have seen their family isn't rich. Their insurance is Safeway insurance, it seems shady and I guess its a pay-by-month plan and they stopped paying a month ago.

Second, we also found out that our insurance company had my brother's car on just liability, so there is no help to be had from them. I don't know how that happened but that's niether here nor there.

I dont think there is anything that can be done, besides pay for the towing and my brother's new car out of our own pocket. I guess this is more of a rant than anything.

What do you mean you don't know how it happened, in regards to your brother's car having only liability? Usually the company only puts you on liability only if you specifically ask for it, most of the time they want to make more money off of you by having you carry full coverage.

I suppose "that's neither here nor there," though.

Hope your brother didn't suffer any permanent injury. The fscked-up car is a minor bother by comparison if your health is seriously affected.

I don't think you're necessarily a fool for not having it. Afterall, insurance companies making money on you. From a money perspective the odds are stacked that the less insurance you buy, the better. Of course, in reality I (and most people) don't have the cash on hand to cover losses, so I get insurance, and quite a bit of it. If you don't have the money to replace a car if it's hit by an uninsured motorist, then you're right it's a stupid thing to not have that insurance until you do have the money.

So you mean that form that they make you sign...the one that says "I agree to decline underinsured coverage <initial here> and uninsured coverage <initial here> <signature> <date>"...he was asleep at the time?

You guys are missing the point. Im not saying insurance should pay for it, those were all his mistakes and I cant help him with that. Ill just ignore what you guys said about that since that isnt what this thread is about. I am actually kind of surprised this thread took a turn in that direction, and am a bit disappointed. The point of the thread was to see what can be done, because the girl was AT FAULT. My brothers insurance shouldnt have anything to do with this, but the girls is invalid.

Anyway I went to the yard, its even worse than I thought. Here is a pic Accident
