If you can't sue her, and her family is illegally here, tell them that they will have to pay for a replacement car asap

If not, call the INS and have them picked up and deported.

How could a poor family afford a camaro? Even if it was a v6, the price per passenger seat ratio isn't very good...I would expect a compact like a corolla or an accord or something. Maybe they have more money than they let on.

Did he say it was a new camaro? You do know that a lot of people reading this thread can go get their local 'Wheels & Deals' type magazine and find some crappy Camaro for $500.

No shit. . . but, if not, then sue.

Some musings:
Did said girl have a drivers license? If so, wouldn't she be legal? Or do you live in some crazy state where illegals can get drivers licenses?

Is it illegal to physically harm illegals? Sure, it's ethically wrong, but if I were in your brother's situation, I would have gone postal.

2) File a lawsuit against Mexican government. yadayadayada PROFIT!

Haha, yea she had a license because I assume she was born here and is therefore legal. I was more questioning her family members.

The court can place a lien on the vehicle owner's asset such as a house or garnish a portion of wage under court order.

And this is why I have uninsured motorist coverage on my insurance. So that if something does happen I'm not screwed.

I kind of went through this about 2 and a half years ago. I was driving to work in my 2000 GMC Sierra, and there's an intersection where they have needed a turn signal since the hospital opened up down the street in 1972. I was doing the speed limit, 50mph, and a 20 year old kid, driving a 95 Camaro Z-28, turned in front of me when I was already in the intersection. I took the front end off it, and then hit and tossed a 99 Cavalier into the ditch that runs along the road. She was shot almost 100' down the road. They had to cut her out of the Cavalier, it was so tweaked. Nobody was hurt, except me.

The Camaro and the Cavalier were both totalled, but my truck came through in what appeared to be pretty decent shape. The kid driving the Z-28 had no insurance, of course. He has no money, the car is a nearly 100% loss.

My truck had the "black box" in it, and it gave an interesting readout of the wreck, and it backed me up 100%, as far as speed and braking went. I was going 52MPH , and the throttle was almost at idle. The throttle goes to zero, and the brakes go to full (I think it was 255 of 0-255 levels) .14 seconds after I lifted off the gas, I hit the Camaro (speed drop to 36MPH almost instantly. The airbag didn't fire, since my left quarter panel and tire and "nerf bar" took most of the hit, then I slammed into the left rear of the Cav, and the airbag blew. My speed went from 36 to zero, instantly. A whole bunch of G's when it hit. This whole thing happened in the distance accross one intersection from start to finish.
If I hadn't have hit the Cav, I would have slammed into a huge light pole, and then gone into a ditch. My insurance actually went DOWN after this wreck! They said that the readouts showed I couldn't have done anything to avoid it, and so I wasn't penalized in any way, even though they had to pay out a fair chunk of cash.

Anyway, my truck was about 11K to fix, and my insurance company gave the woman something like 8K for the Cav, and a couple K for the hospital bills from getting checked out. My bill was over 7K, and also another 300+ for glasses and another 450 bucks for "incidentals". They sued the kid in the camaro, and got a judgement for 30K+ and he's paying for it in weekly payments.

Sadly for me, I came out of this deal with a permanent injury to my left leg. It was all bruised up and hurt like hell for weeks. It was swollen, but I just thought it was due to getting so tore up from me jamming it into the floor, or whatever. Well, it never went back to normal, and it's probably going to stay like that..forever. I would sue the kid too, but he's broke, so, I live with it.

I'm driving to work a few hours ago, and there it is, A TURN SIGNAL. Let's see, one fatality a year for 33 years and about 8-10 big wrecks there a year and they finally put the light in it should have had all along. Too late for me...

Hey man if he's alright and she's alright it's all that matters. Trust me it's worse when a mountain bike collides with a car traveling at 40mph. I'd know first hand...

Definitely sue, otherwise she'll live the rest of thinking it's ok to drive without insurance.

Perhaps next time she'll kill someone when she plows into the side of their car?

lol, much too simple there.

Seriously though, now I am worried. I don't have underinsured motorist on my insurance, so what happens if I am hit?

You should consider getting it. It might help you out significantly. For example, I was hit by a lady in a minivan who was going 40 in a 20 failed to yield to me while I was crossing a crosswalk and away I flew ya for a while. Then I hit - ambulance - hospital for a few days - more time off - school finals (PITA if you have constant migranes) - Attorneys. Now if the lady has minimum coverage (they wrote her insurance info down on the police report so she does have insurance) however my hospital bills were pretty high so the least coverage she can have is $10k and my bills are more than that. Anything over that, my health insurance covers 80% of it, and my father's policy covers the other 20%. Yes my father's policy I don't even have insurance myself, I'm not on that policy but as a dependent blood relative, I qualify for that. It's a thing that's definetly worth looking into buying.

As for your brother, OP, I'd suggest 1. Contacting the family and you can see if you can work something out with them. 2. If not first contact the authorities and discuss the insurance in question 3. Contact several attorney pick one and go through the legal battle. I could almost guarantee you that once he sends them the first letter notifying them he's representing you in the following case, they'll pay up.

Good luck in your case but as I said before health is everything man, a car can always be replaced.

Word, its on all of my cars, its a no brainer

wow i didn't know people actually chose to NOT carry this! it's so cheap... I was in an accident back in '98 with someone who had no insurance and it was entirely their fault. My insurance company paid all medical bills and pain and suffering, etc. and I had to sign something saying if my insurance company decided to take action against the person I hit I would testify.

hhaha l laugh everytime i see that, pain n suffering, it makes me cringe and i have no idea why lol makes people sound like a bunch of wimps but then again it is another ticket to some money
