6. She was also repairing scratched CDs for $5 a pop with the kids getting back the original CD, and her Wave file extraction (readable and working) and for an extra $3 they got an additional CD with the MP3s from the origional CD encoded as well.

As said before, THIS IS LEGAL!!!

If she had each person sign a statement that they legally owned a copy of every song that she put onto a comnpilation cd, then she would likewise be doing a legal service. (But we probably don't want to teach her the intricate loopholes of the law just yet.)

While everyone is mentioning the fact that what she is doing is illegal (or at least some of it), I must point out that she was performing the transactions at school. This is a quick way to get suspended. You need to point this out to her. Not only is she breaking the law (and is highly unlikely to have any run-ins with the feds), she can be subject to school punishment as well. Take it from someone who ran a counterfeiting ring in 7th grade and got 3 days suspension as the ringleader. (Long story) She must understand these consequences as well!

And for the record, as a card-carrying member of the AFM (American Federation of Musicians), I'm not happy with the way the RIAA is making us all look. Most of us professional musicians make money from live performances, NOT from recordings. That's where the big businesses make money, not us.

I'd heard it was the other way around. Actually, I'd heard that no money is made from live performance. It costs so much to move the production around that you're lucky to break even, and hope you've picked up new fans who will purchase your work in the future.

I think it was Robert Fripp who mentioned that tours never make money. I've enjoyed lots of his journaling on the subject of the economics of business, and would love to be involved professionally some day.

As for any potential "punishment", I don't think she should get to save the money for college. That's like telling a bank robber who gets caught that he can't have the money now, but we'll dump it in his IRA. Since making restitution is not really possible here, I'd have her donate it to her favorite charity. If she likes animals, maybe a local shelter. Or a food bank or homeless shelter. I wouldn't make it available to her later in life. I'm not sure that teaches anything, if that's the goal.

But more important than the money, as mentioned, is getting her to understand why what she did is wrong, which might be tough to do at this point in her life. But maybe point out something she's created, either musically, artistically, etc., and see how she'd feel if you wanted to make copies and sell them, and keep the money for yourself. Dunno. Just thinking here.

It's hard not to admire the sense of entrepreneurialism here. I hope she doesn't lose that spirit. But as she matures, she'll be able to make more informed choices. That's much easier to teach than the part she's already got!

I'd heard it was the other way around. Actually, I'd heard that no money is made from live performance. It costs so much to move the production around that you're lucky to break even, and hope you've picked up new fans who will purchase your work in the future.
Crimson King - that only applies to rock/pop musicians. Most of them have nothing to do with the AFM. We consider them "entertainers" most of the time. The majority of the professional musicians make very little money from CD sales, in fact, many professional musicians get paid for the recording session and see nothing from the sales of the CD themselves, that all goes to the recording studio and the "headliner". There are many of us who work long hard hours for peanuts and are quite happy to do it. While I would love to make the big time, I am not a rock/pop musician, nor do I want to be. I just want to be able to do what I do, and not be left without a career.

The studios rarely get anything above time and materials. If you mean to say "Record Companies" that may have been true at one time, but few, if any, Record Companies own and operate a studio operation for the benefit of their artists. Those "entertainers", as you so disdainfuly refer to them as, are very often American Federation of Musicians members as well. It is necessary to be one (an AFM member ) in order to perform in some venues.

Just read through the whole thread, and wanted to say that I think you're doing the right thing, Jimbo (well, it's what I would have done if I were an adult and had a kid in the same situation). Explaining that what she did was wrong, but not punishing her (save that for later if she does it again) was probably your best option. Also, it is wise not to send the money to the artists (who deserve it, but you never know if they'd actually get it), or the RIAA (who doesn't deserve it, and would probably "make an example out of you"). Letting her invest the money for college isn't right, so donating it to a charitable cause is probably your best option now.

FWIW (concerning posts on pages 2 and 3), I had an IBM PS/1 with a 10MHz 286 processor, 1MB of RAM, and a 30MB hard disk that I used mainly for word processing (school papers looked oh-so-beautiful when printed on my Epson dot matrix printer ) and QuickBASIC programming. It was given to me around when I was about 9 (that would have been sometime in 1994 or '95, according to my quick and dirty early-morning math), and I had it until 1997, when the old hard disk died. Shortly thereafter, I got a 233MHz Cyrix, and it went downhill from there. Before I had the PS/1, I learned DOS on my dad's IBM PS/2 with similar specs (only it had a 20MB hard disk and a grayscale monitor; my monitor was a 16 color 640x480 model).

Funny you should mention that, in Canada, for every CDR, CDRW, cassette, etc. you buy, you are already taxed by a private organization called the CPCC, which is the Canadian equivalent of the RIAA/MPAA. Info here They've already amassed CAN $28 million.

It should be noted that no Canadian artist have yet received any compensation from this "CDR tax", although the CPCC did send their entire Ottawa office to an "anti-piracy conference" in France last year. So, in a twisted sort of way, you could argue that, if your daughter did this in Canada, she was already properly compensating the music artists with every CDR she sold.

Jimbo, I admire your daughter's creativity and saavy. I also admire your solution - just letting her know it's wrong, investing her money, and encouraging her future enterprises (ie. CD repair/backup).

I listen to almost anything (initially), so it'll probably appeal to me.
