Not according to your Win7 Upgrade license agreement. Any previous OSes contributing to your full prior OS license for that computer must be dedicated to that machine.

For example:

Say that computer was originally purchased with a full Win98 license and was later upgraded to XP with an XP Retail Upgrade package and then further upgraded with Win7 with a Win7 Retail Upgrade package (the Family Pack). You must dedicate the original Win98 license AND the XP Upgrade license AND the Win7 Upgrade license to that computer You can't use any of those licenses on another computer while the Win7 Upgrade is is being used on your computer.

If you want to re-use your previous OS then, legally, you'd need to be a FULL license for Win7 (either OEM or Full Retail).

That is one of the single most retarded things I've ever heard. That can't possibly be true...

It makes perfect sense as the Windows 7 is just an upgrade not a full version. It is riding on the back of the full license. Though if I was using the upgrade version of Windows 7 I would be installing it on say Win98 or better yet Win ME

But Windows 2000 or earlier aren't qualifying OSes for a Win7 Upgrade.

But, yeah, it DOES make sense. There's no sense offering an "upgrade" for a computer that doesn't have a previous OS license. You wouldn't expect to build 1000 blank computers and put Win7 upgrades on them just because you happen to own 1000 other computers that have XP on them. You'd need to put "Full" licenses on them.

Based on MS' not even making "Upgrade" versions of MS Office 2010, I wouldn't be surprised if MS drops "Upgrade" versions of Windows in the future and only sells "Full" licenses. It'd make life a lot easier for those who have to buy and repair PCs.

http://www.microsoft.com/windows/windows-7/get/upgrade-considerations.aspx
"Should I buy an Upgrade or Full license of Windows 7?

All editions of Windows XP and Windows Vista qualify you to upgrade. So, if you're running either on your PC today, buy a package labeled "Upgrade". "

Backup and save all your XP files to an external drive. Double check to make sure everything is there. Format the drive or drop in a new drive and do the double-install trick to use the upgrade edition on a clean PC. When you first install, don't enter a CD key during the install. When it is all done, put the Windows 7 upgrade CD back in the drive and run the install again. This time put in the CD key. When it is finished activate with MS and it should work fine.

Here's where the various EULAs are available:
http://www.microsoft.com/About/Legal/EN/US/IntellectualProperty/UseTerms/Default.aspx

If you select Windows 7 Ultimate, for instance:
"UPGRADES. To use upgrade software, you must first be licensed for the software that is eligible for the upgrade. Upon upgrade, this agreement takes the place of the agreement for the software you upgraded from. After you upgrade, you may no longer use the software you upgraded from."
