In regards to Gamestop specifically, I don't like that business practice as a consumer but I understand why they do it. I am also not anal retentive. If there are no scratches and the disk works then it is as good as new. If I happen to be the type of person who really values actually opening the sealed case then I may opt to wait until their next shipment. That or I would just simply accept my loss in this one case and not pre-order from them anymore. Besides, you really do not need to pre-order anymore these days unless you wish to do the midnight pick up thing. There are always copies being sold somewhere and they are usually very easy to find if you just take 5 min to call around and ask them to hold one for you until you arrive.

I know what happened at GameStop was wrong...they deserved what they got from me. Who cares if you think I acted like a kid...you weren't there...you just assume things.

I refuse to buy open-box items without careful inspection.

If it's not brand-new, I'm not paying brand-new price for it.

Not a big deal though because I always buy my stuff online...

Also, just because a salesperson at a competitive store tells you what gamestop is doing is illegal, doesn't necessarily mean a law was broken.

Actually, you can return it still. They make a note of it on your receipt or in their records that your game is new and you have like 30 days to get a full refund.

They put a little plastic sticker on the case to close it. If you break said sticker, you can't return it. If they can take the plastic wrap off and sell it as new, I should be able to remove the sticker (and put my finger prints all over everything) and be able to return it as new also.

I've never seen that before, all the games I've bought from GS have been sealed in plastic?

that's pretty ridiculous, I wouldn't have acted like a gash though.. simply just refused to purchase it and taken my business elsewhere.

I fully agree with the OP, and this should apply to everything.

Brand new means in factory new condition. So if it comes sealed from the factory, you should get a sealed game, PERIOD.

It's probably a moot point after the stupid turn this thread took after reply #1, but regardless of what the OP said or did, I agree that if a game is opened, they shouldn't be allowed to sell it as new. On one hand, the package has been opened and you don't know what's missing (sometimes games come with free offers that could've been taken by the employee or a customer). On the other hand, as a former Gamestop employee as of last summer, employees are allowed to take home any game in the store, even new games. Last year, I took home a copy of Madden 08 a week before it's official release date. I opened it, played it, then brought it back the night of the midnight release, at which point it was sold to some sap who didn't know any better. I also took home a brand new, shrink-wrapped copy of The Bigs, opened it, took it home and played it for a couple of days, and brought it back and stuck the box on the "New" shelf. And if I had a third hand, I'd argue that some of us gamers don't like getting an open box as a new game with the sticker on the plastic cover.

Sure, it's just a digital copy, but it's the principle of it.

Same thing happened to me with my Copy of Mass Effect for PC.
It even had a small scuff on it. I didn't feel like making a scene so I figured that if my PC had trouble reading it I'd exchange it.

That's another problem with opened games being sold as new. In this day and age, if a game is opened, you can only exchange it, you can't return it. So what happens if you buy a gift for someone and they already own the game, or you buy a new game and get buyer's remorse before opening it? There's no taking it back unless you can talk the manager into it or you the person who rung you up remembers you.
