Ass kicking? No. If you behave yourself as you described, you could be looking at a warrant. You changed your tune rather quickly here..didn't get quite the reception you expected on AT?

Hey now, the only thing I assumed was that your OP was truthful. Apparently you're a liar too?

A warrant huh?

Yup, I absolutely hate it when they do that.

That, along with rip-off prices on used games (for which you can find cheaper at places like Half.com), I rarely ever buy games from GameStop anymore.

Dude, chill out a bit. It's a disappointment but then so is life.

On another note, by "StarsFan" do you mean the old game from 1996 - galactic domination via Excel spreadsheet interface? http://starsautohost.org/ ? I recently rediscovered it and found a copy online and have been having a blast.

Do you seriously want a discussion on the laws of arrest and exceptions to the warrant requirement, or are you just playing stupid?

No answer on the last bit...I see how it is.

So you are going to issue a warrant for my arrest now? Nice!

I wouldn't have raised my voice at the clerk, but I wouldn't have bought the game either. All Gamestops are like this now, and its horrible.

I have only bought 1 of their "New" games, and that was last year during the holidays. I wanted the game, and it was the only one in town (Could have ordered online, but didn't want to wait.). It was a DS game, and nothing was messed up about it. They put a piece of tape over the corner of the case, and said I could return it for a refund if the tape wasn't removed. It wasn't a gift, but they were doing this to all games because of people buying presents for Christmas. I overheard one lady in there returning a game (she bought a PS3 version and her son had a 360), and they wouldn't take it back. She eventually got them to give her a refund, after she told them about 5 times that the game was opened when she bought it "New" from them.

I hardly ever go to Gamestop anymore because of the "New" but opened games. Also I don't buy their "Used" games either since most of the time the price difference is so small compared to the new ones, Also half the time people don't even trade in the game cases, or the game is scratched up and has food or something else all over the case and book.

who cares if it's sealed or not?

just take a look at the game and make sure it's not scratched. I look at it as them saving me precious minutes of my life that I'd have spent trying to undo the nefarious sealing witchery.

Don't reserve games, discs are easy to mass produce, and you can typically have very little problem finding a store that has them in stock, tons of people reserve games at big box stores like best buy, target etc, they still have tons more sitting on shelves for anyone to pick up, it's a waste of time to reserve them. Game consoles are different and do sell out because they're not as dirt cheap/easy to mass produce quickly(maybe games that include something other than a disc might see this too)

If you hadn't invested money ahead of time in reserving it, you could have chosen not to give them money and paid someone else for the game plain and simple. Yelling at the clerk really does nothing except give you both headaches, they have so no control over the policy, so it is pointless to hassle them over it.

To the best of my knowledge this isn't illegal don't think it should be, don't reserve crap and you will have choice over where to make your purchases in the future.

That happened to me once but the disc was spotless so I really didn't care. I don't know why Gamestop does that crap, they've been doing it for as long as I can remember.

if they use your product as a demo, the very least it should be given a demo open box discount. otherwise yea its pretty shady to sell people manhandled stuff. its simply second rate service. if they don't clearly advertise that what they are selling is probably going to be opened, they shouldn't do it.

anyways, the only rational thing to do is not to support such a store. i stick with amazon and frys frys sells out of a game, theres no empty boxes laying around. what would be the point if you can't buy it anyways.

I have bought a few used games a while back from GameStop, but wasn't aware they do that for new games as well. I would have to agree with the OP--the practice of selling opened games as "new" is shady. I can see others who don't really care seeing as if the game works and looks "new" it basically makes no difference to them but for others it IS a problem, one of principle. I mean if you wanted to buy an ipod or something, and the cashier pulls one out of a drawer and sticks it in a box how would you feel? lol

With that said, I think you could have handled it differently. Assuming you only had the options of getting store credit or waiting for a new shipment to come in there's nothing you can really do. Raising your voice there and causing a scene there isn't going to make a shrink wrapped copy magically appear and the other customers will just think are loony. Also, working retail is shite, I would you hope you are nicer in the future-- the girl behind the counter really can't do anything but apologize to you... I mean put yourself in her position, if it's GameStop's policy, it's their policy and she can't change it even if she wanted to

Obviously not. I was hoping you possessed at least a shred of intelligence, but I'm starting to have my doubts..

Hopefully they trespassed you from Gamestop.

It's not REALLY that big of a deal is it? Fingerprints aren't hard to get off. I could see you being pissed if there were scratches or something, but you sound more like a baby than anything else.

No...sorry man. I am no baby....im not a pussy like you. I guess in your case you would let a business ass rape you and send you on your way....

So the business actually giving you a game is being assraped. They could have told you to fuck off and not given you anything. If i was in their position, that is exactly what I would have done.

I think someone needs to grow the fuck up. Got a problem with the store or the way their selling their products? Ask for the manager, explain the problem, and see if it would be willing to correct it. If not just calmly leave and don't shop there again. Pretty simple right?

Your statement is null and void because it uses common sense.

Same thing happened to me with my Copy of Mass Effect for PC.
It even had a small scuff on it. I didn't feel like making a scene so I figured that if my PC had trouble reading it I'd exchange it.

That's another problem with opened games being sold as new. In this day and age, if a game is opened, you can only exchange it, you can't return it. So what happens if you buy a gift for someone and they already own the game, or you buy a new game and get buyer's remorse before opening it? There's no taking it back unless you can talk the manager into it or you the person who rung you up remembers you.

That's not a problem. If you are worried about that then just buy it from somewhere else. Problem solved.

Tell that to an uneducated mom or aunt who is buying the game.

x1000. Try to return an opened game, and see what happens. I avoid Gamestop for this reason.

That is there real reason for doing this. However I heard they do take returns so I don't know for sure.

Still some may be looking to resell and REQUIRE a sealed container. Regardless though if one is buying a new item unless the contract specifically states otherwise, they should expect it to be handed to them exactly the way it left the factory.

Ebay used to ban the word new as a description (not sure if they still do).

There are two main reasons why Gamestop does this:

1. Theft - I run my own retail store (not Gamestop) and I can tell you that people will steal anything they can get their hands on. Just the other day someone stole a $19 copy of Bratz for the DS. In fact anything above $35 dollars needs to be kept behind the cash, simply because people will steal anything.

2. Copyright - In our stores we have to open at least two copies of games for display purposes. It would be much simpler to just print off a copy of of the game cover and display that, but we can't. Those images are copyrighted and if the games companies saw that we'd be in trouble. But the fact is, we need something to display or you would have to come in and ask every time whether or not something was in stock.

With that being said, we sell the opened copies only after all of our unopened copies are sold. When selling someone one of the opened copies, we just explain why it has been opened and no one has had a problem with that. As well, none of the copies leave the binder unless they are being sold. We don't have a "try out" policy at my company. It sucks that your copy had to be one of the opened ones, but I think it's a small price to pay for the store trying to merchandise things properly and neatly.

You didn't like the way they do it, so you voted with your dollars which is cool. But why get upset and yell at one of the workers who has nothing to do with company policy?
