Really? Just how stupid would a person have to be to get nailed on it? Just how stupid would a person have to be to be nailed on it a 2nd time after learning how strict it was the first time? Doesn't a person that's learned not to be a dumbass protect the public safety? OP was a dumbass and will hopefully learn to at least not be a dumbass in Virginia even if he's a dumbass everywhere else.

uh, going over the speed limit is not being a dumb-ass, actually, I'd say at LEAST 90% of all drivers do it. So GTFO.

you're on ATOT. everyone here is an angel and follows the law to a T and makes 6 figures.

And I'd say you pulled that stat out of your ass. If you don't have anything intelligent to say on your own at least have the common courtesy to avoid inventing lies. Then I don't have to take the time to smack you around for being a dumbass too.

Even if 90% of drivers did speed this law would sure prevent it. Risking a $3000+ fine to save 5 minutes is most assuredly being a dumbass.

Haha, too bad ad hominum attacks aren't valid in any argument. So STFU.

That stat came from everyone I've ever driven with, and, let me get this straight, you never go over 30 in 30 zones? You never go over 65, ever? I can almost guarantee you do.

The point is, $3000 is an INSANE fine for an offense that such a large percentage of the population does.

The dumb-ass here is the one ignoring the 8th amendment.

Unless you drive exactly the posted speed limit everywhere you go, you're full of it. Nearly EVERYONE speeds unless you watch your speedometer constantly or set the cruise control for every speed limit sign you see.

Now the degree in which each person goes over the speed limit is something completely different.

The simple fact is that they're jacking you because the state needs money. When I visited Williamsburg there was a big highway with the speed limit set to a ridiculously low 35 mph, and there were cops all over the place hiding trying to catch "speeders". Of course they're going to catch a lot of people because nobody can drive 35 mph on a highway.

Once this mess is over (and assuming I don't become a temporary resident by getting a jail sentence) I plan to NEVER drive through or go to that state for any reason. I guarantee that I will warn everyone I know about it as well.

you're not going to jail for a first offense out of stater, trust me. Unless you had a bag of weed or bottle of vodka open, you're fine. It'll be expensive, and a headache, but not much more than that.

I didn't think I was going to get a $1000 fine for speeding either... So at this point anything is possible.

The dumb-ass here is the one ignoring the 8th amendment.

90% of the population doesn't drive over 80mph in a 65 zone. That's just dumb.

Speaking of logical fallacies, you are now accusing him of speeding just because the people that you hang out with speed. You are judging him to be guilty because most people are guilty. You are also taking the original argument of going 80+ mph and changing it to going 1mph over the limit. SO STFU.

People who are dumb enough to excessively speed deserve punishment. If you are going 15+ over the limit, you are just asking for trouble. I don't think that a $1,000 fine is out of line. I don't think that a suspension is out of line. The laws are made available to everyone, so it shouldn't come as a surprise when you break the law. What do you expect for excessively speeding? The police officer to give you a lollie pop and ask you to slow down?

What kind of a punishment do you think his crime deserves?

So we should just follow laws blindly, then? Clearly, no laws politicians ever dream up are unjust, and anyone who breaks them is a complete dumbass for doing so.

Led by state Delegate David B. Albo (R-Springfield), lawmakers slipped a driver responsibility tax into a larger transportation funding bill signed by Governor Tim Kaine (D) in April. Albo, a senior partner in the Albo & Oblon, LLP traffic law firm, can expect to see a significant increase in business as motorists seek to protect their wallet from traffic tickets that come with assessments of up to $3000 in addition to an annual point tax that tops out at $700 a year for as long as the points remain.

http://www.thenewspaper.com/news/18/1818.asp

This is a politician and state legislature gone completely bad. Albo is acting with his own interests at heart, and the state legislature is trying to find a cheap way to the shore up the state's budget. These legislators are elected by the people of Virginia and should have their best interests at heart. This law has proven incredibly unpopular, and in cases like these, the law should be challenged.

Thank God everyone doesn't think like you do. You probably would have thought black people were dumbasses for trying attend segregated schools.

From the OP:
I was scooting along around 75 on the 65 mile an hour highway. We had thought we had missed my exit and were a little lost so I sped up a to get around a truck. Of course I get nailed ended up getting clocked 83 in a 65.

He wasn't even going 15+ for long; he wasn't exactly cruising above 80. Passing a truck takes around 5 seconds. 10 over the speed limit was probably the flow of traffic. I would not call that "dumb" driving or excessive speed by any means.

I will be calling who I can only assume to be the local magistrate tomorrow. I plan get the officers information and talk to him as well.

One of the worst part of this entire situation is that officer never mentioned that I was being cited for reckless driving. I am only now finding out it was actually for reckless driving. He even went out of his way to no write reckless driving on the summons. He actually abbreviated it. It says "r.d. speeding 83mph/65mph posted". How was I even suppose to know what that means? The whole thing was very shady.

There is even a highway in VA with the speed limit set at 70mph. In that particular stretch, merely driving 11 over the limit results in these draconian punishment and fines.

This article might be interesting to you.

It doesn't cover your situation, but it shows that VA legislators have already had some of these idiotic laws proven invalid and repealed.

Virgina can't give you 6 poins on your license. Only the state that issues your license has that authority.

A lot of state's honor other state's punishments. Can't know for sure, only guessing.

Here in NJ, any out of state offense is 2 points (or it was when I got my license). Check with your state.

I can say with certainty that NJ offenses do not carry over to PA. At least they didn't 5 years ago.
