He didnt kick them out, he refused to serve. Big dif.

It's generally illegal to bar people by age unless the establishment is a bar or a strip club. If only California Pizza Kitchen had strippers, I could enjoy their food undisturbed by heathen children. :\

There are plenty of places that state "No one under 21 allowed".

at the same time I have seen young children in bars with their parents numerous times

what they really mean no one underage that can be confused for drinking age is allowed

I wouldn't want to sit next to a loud and rude customer either, even if they had down syndrome. However, if he made that comment just to poke fun at the kid than I can agree with the waiter.

It's been a long fight with the Army (apparently it's better to accidentally have kids than accidentally not have them,) but I should be getting fixed next month. :biggrin:

They should have simply asked for another waiter. One who would serve them. I don't have anything against special needs kids, I just wish they'd be special at a Mcdonalds or Burger King. Not where I'm trying to have a nice meal.

My kind? That is the business' choice, not mine. If they said no kids, then fine. The restaurant in the Op did not as it was a "family restaurant".

Nebor was telling people with kids to go to McDonalds or stay home and eat. I suggested for him to take his own advise. I never said anything about serving anybody with or without kids so keep your own words to your own self.

And I don't want to have to sit around a condescending, uptight, snobby little prick. That sit there and talk on the phone making sure everybody else can hear them.

Then you'd have to eat at McDonalds or Burger King, too. You put the "special" in "special education".

The guy's remark offended no one but the server, but he made a successful effort to spread it around. Some hero.

He's not a "hero", but I applaud him for refusing to serve that customer.

read the damn story, the waiter who refused service didn't "spread it around".

As the father of little kids I don't take them to high end, expensive dining establishments. But anything with family in the name is fair game..

good point.....pretty much all bars in my area serve food so thats not a distinction I am used to

though most go to a age requirement after like 10pm. But a few weeks ago a booth behind me had a like 6 month old chillin in the car seat passed the hell out while they were there having a beer

OK, my bad. It was another server who told the family. Where did he get his info? Must have been from the first server who was "spreading it around".

Still, the family would have suffered no harm except for the wait staff.

And by-the-way, the mother did say that maybe the kid was a little loud at one point (said the adults were louder). It's been my experience that when a parent admits to their kid being a little of anything negative it usually represents a very limited perspective.

And as for the right to refuse service, that is almost universally reserved for management, not wait staff. Management might have handled the whole thing better.
