While I know we are jaded by BS lawsuits, I think this guy has a case.
And I'm a business owner.
Walmart knew it had a problem with snakes, and even went so far as to issue snake repellent to it's stores.
The man was injured through absolutely no fault of his own and by no act of carelessness on his part on Walmart's property. The snake was an unassumed risk. Honestly, how many of you think "I better be careful of snakes" when in the garden department of your local megamart?
Walmart should be offering to cover all his medical bills and his lost wages now, instead of creating a PR nightmare by claiming BS like "act of god." They are going to pay either way. It would be better for them to come out smelling like a rose (a rose without a snake).
