We are under a major water restriction here in S. Florida. A couple were talking today how they feel it's communistic and against our freedoms.

I don't feel that way, but a lot of people are up in arms about it.

Those on the Island of Palm Beach were in the paper a couple weeks ago...some of them use over a million gallons in a month. It's insane.

I'd say no; one person's freedoms extend so far as until they begin to unfairly infringe upon the freedoms of another.

I'd think that me not having the water to cook or bathe because someone else wanted to wash their car or water their lawn would be an unfair infringement on my freedoms.

I don't recall seeing "freedom to waste unlimited quantities of water" in the consitution or bill of rights, ask them to find it for you.

The water is being delivered to them through city, county and state-owned plumbing, from city/county/state/federal sources.

If they pay to truck in their own water from somewhere with an oversupply then they might have a case.

I just don't like how businesses and multifamily housing are excluded.

I always wondered why there is such a shortage of water, when the area is surrounded by water. Can the cost of desalinating ocean water be that much more expensive than getting sewage out of water?

But i do notice there is a huge amount of sprinklers and water systems in the Boca Raton area.

That's why I like living next to the Great Lakes. I can use 10 million gallons of water a day if I want...it just gets recycled in one form or another.

it's a limited resource. You can't expect enough to go around with unlimited immigration and population growth.

So that states have the say. Good.

"Or to the people". But my objection to your statement lies in the dangerous thinking of "it's not in the Constitution, so it doesn't exist".

I hear ya. I'll leave P&N to P&N. I agree with your line of thinking.

Now that that is settled...

If municipalities wish to temporarily restrict water consumption, I have no problem with that.

Well in my defense the original question was the "is it unconstitunational?"

The answer then would be nope.
Is it delegated? Yep.

Right, it's 100% constitutional for the states to do so, I just wanted to clear something up. That's all.

Pfft, diddums. We've ben under water restictions in Aus for ages. They don't work, of course, and people end up using more water because of them, but that just makes them stupid, not unconstitutional.

Next time you hear people complaining about it being unconstitutional, clue them into Article II, Section 7 of the Constitution of the State of Florida.

SECTION 7. Natural resources and scenic beauty.--

(a) It shall be the policy of the state to conserve and protect its natural resources and scenic beauty. Adequate provision shall be made by law for the abatement of air and water pollution and of excessive and unnecessary noise and for the conservation and protection of natural resources.
