Yea thats true I am not able to sign for my next of kin or relatives but it does say they can not sue.

My experience is this is BS. They can't stop you from suing and a judge would likely throw out this form as being unreasonable. Not to mention the fact that many employees could argue diress when signing due to the threat of repercussions for failure to sign, which makes it a non legally binding form anyway. Don't take my word for it, however, this is simply my interpretation.

Plus, as others have said, you cannot sign a legal document for other people regardless of whether or not they are in your family (this does not include minors under the care of the person, but even then, you cannot sign a binding document for future action when the minors are of legal age...)

So the bottom line is sign it as it will likely hold no weight in court should anything happen. If you are really concerned, find a lawyer and ask advice.

Agreed. If they were obviously negligent in a situation, like if there was sexual harassment going on and they were neither discouraging it or dealing with it, but in fact were seeming to promote it, then you could still sue and very likely win. Agreements like these are more often than not scare tactics, a way for the big company to make the little guy/gal think that they have no choice but to fall in line.

So you can't negotiate anything as an individual. Your employer is a large entity, with lots of resources, who can easily afford to fire you and hire a replacement, while if you lose your job you could lose everything-- of course they can make you sign anything they want.

Last I checked, one person could nit sign a legal document for another person. How can you sign away the rights of your kid?

You are binding your heirs' and assigns' right to bring action on your behalf or arising from your vested rights.

No union and at will work laws in play. They dig that fact in too. Like you do not have a right to work here.

What you described is standard operating procedure.

Your father was free to sue his heart out, but he didn't. He took the offer. The blame is purely upon your father and nobody else.

You aren't entitled to any kind of secerance at ALL. He was lucky he got something.

Considering he had been working an average of 60 hours a week plus being on call 24/7 for 6 years because the company refused to hire more help yet continued to tell him they would, yes he was entitled to a severance package.

Someone made a lot of money by working him like a mule and it sure wasn't him.

And before you say it, he had been looking for a new job the last 2 years. Unfortunately, it's hard to find work in smaller markets when someone has over 25 years of experience and commands a large salary in his field.

Did he have anything to sue them about? No. But I find it unethical and disgusting that they would dangle a carrot like that over someone they just told was being laid off with no warning but he had to promise never to hold them accountable IF they had done something wrong to him.
