Cliff Notes:

Wife's ex ran into bus, estate is suing bus company for wrongful death, as they violated the right of way.

Ex was a heavy weed smoker, bus company is claiming to be able to prove how high he was & when he last fired up.

To the best of my knowledge, that's impossible to prove.

Any links, suggestions, studies, etc? I'd like to be able to provide our attny with something to hit them back with.

I am not an expert, but I would think they could tell by the level of THC in his blood during the autopsy.

Outside of that, you will have to talk to a lawyer.

They would have to have a blood sample from immediately following the crash... then they could tell how much was in his system. If it?s a really high amount then they can determine that he was high at the time of the crash. I know this because my mother had me tested one time and I had just smoked a joint when the test came back and my mom confronted me she was like "you were fvcking high when they took your blood!!!" Apparently I had the highest level of THC in my system they had ever seen.

lmao, what if you just smoked weed all the time but werent high at the time, your THC would still be really high.

Like someone said, only if they get a blood test taken from exactly when it happened. Thats the only way to measure how high someone was at the time. Akin to a Blood alcohol level.

The pee tests only test for a certain amount of thc and its indicators in your urine. A giant blunt smoked two weeks ago will look the same as a puff taken a day ago. No way at all to tell which was the case, as far as I know.

They could probably still test the level of THC. THC is stored inside of fat cells in the body and is released when the body does excercise. For a light smoker THC usually stays in the body for a couple days, for a heavy smoker it is usually in the body for about a month to a month and a half. I would assume the THC is still in his fat cells since he is dead.

The thing I think they would have a hard time proving is at what THC level is one considered "high" or too impaired to drive.

I am not a lawyer, but I would say that since Marijuana is an illegal substance, all I think they will have to do is say he was impaired and operating under the influence of a drug. I would guess since it is an illegal substance, they would just have to show that there was any amount in his system at the time of the wreck.

Even if you are not legally drunk and you are in an accident, the insurance companies and police can still try and say that the alcohol was a contributing factor in the crash, and still not charge you with a driving while intoxicated - just under the influence.
