It appears that if polygamy is to be permitted in Montana, it will take a legal battle similar to the path of Obergefell v. Hodges, the case through which the U.S. Supreme Court created “same-sex marriage.”
A court clerk flatly rejected a request for state endorsement of a polygamous arrangement sought by a man, his wife and his live-in girlfriend, whom he reportedly wanted to make wife No. 2.

Polygamy is really about a guy being tired of the first wife and wanting a second but not wanting to divorce, rinse and repeat. It is really about the guy not being able to be faithful. Each divorce would be a nightmare. Think about it. Assets are divided in a divorce. So if wife #1 was married to the schmuck for 20 years and wife # 2 for 12 years and wife #3 for 8 years when wife # 2 wants a divorce, how will the marital assets be divided?
