No, it's not illegal. It would probably violate the card-vendor agreement. However, cash discounts do not violate that agreement. And various laws can modify the contracts, such that terms demanding no minimum charges or increased costs for credit transactions don't apply.

Part of the settlement between retailers and VISA and Mastercard allows vendors to pass on the swipe fees to consumers.

Not illegal, but certainly against the contract with the merchant. They can lose their ability to swipe if they were reported.

Incorrect unless a state has banned surcharges. Only 10 states ban surcharges(tacking on swipe fees) on credit transactions. As of 2013 merchants can add swipe fees to any visa or mastercard transaction in any of the other 40 states.

In July 2012, Visa and Mastercard settled a class action anti-trust lawsuit filed by retailers. They settled because it was a slam dunk collusion case. Amongst other things the settlement allows retailers to pass on swipe fees. Said change to the merchant agreement took effect in 2013. To date very few merchants have chosen to pass on the fees. Mainly because they have to visibly post the swipe fee surcharge.

It's ALWAYS been that way, it's called building into your everyday price. As far as I knew, you could NEVER say "If you use a credit card, you will have to pay a 50 cent additional fee". Correct me on that if I'm wrong (link please, I've actually been curious on this for quite a while).

Quite simple, either build that fee in your everyday price, or take that method of payment out of your equation.

That is unless you live in California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma, and Texas. Those states have banned surcharges being tacked on to credit card transactions. However, most of those still allow cash discounts.

See that's funny, I'm in Texas and I'm the one complaining making the thread. I see it decently often and it's started to crop up quite a lot.

I go to my dry cleaners and they have a sign posted saying "If you use a credit card, you will have to pay a 50 cent additional fee". I tried to use my Debit card the other day, and they said that was considered a credit card too. I feel like all of these need to reported or something

Cash discounts are allowed in Texas. They probably need to fix their sign with the proper wordage.

Debit, in my experience is considered credit. Debit used to have high swipes until the Feds capped it and the courts upheld that cap.

My friend with a store told me that if he has card transactions for under $10.00 the processor charges a higher rate for all their card transactions. My guess is that it is to help cover the costs of all the fraud. I wonder if desperate people are more likely to do fraud for ten bucks or less before payday.

I drive by that station every week, in recent weeks there's been a 30 cents per gallon difference between Cash Regular and Credit Regular. makes me go wth.

I've seen a station where there was a price difference of over $1 a gallon if you paid with credit instead of cash.

I usually get Arco which only accepts cash or debit, but one way around it is to buy gas gift cards at the grocery store using your credit card. That way, you get the lowest price plus the credit card rewards. Only reason I bothered for Arco is because I had to hit a minimum spend requirement on my card to get a bonus and Arco tends to be around 30 cents cheaper per gallon than other gas stations in the area.

That station across the street chooses to lower its prices so as to compete. Gas stations routinely sell gas at a loss because their real profit comes from selling you the other junk you buy when you fill up. The gas price is set solely to get you inside
I haven't seen the data on that, but my likelihood of buying only gas during a visit to the gas station is roughly 99%.

Mine as well. Further if a station pulls that "cash-discount" crap I buy my gas elsewhere even if I had been planning on paying with cash.

The only exception is that many gas stations around here have Dunkin Donuts inside so occasionally I'll snag a coffee. I don't think the station itself gets much if anything out of those transactions.

You know what really grinds my gears ATOT? Gas stations that list "cash prices" on their billboards. As if anyone can read the term "cash" from a far distance, let alone the $0.10 difference is an obvious ploy to be a difference between regular and mid-grade and for you to not notice because your assumption is you always fill up with regular, hence you have the cheapest of 3 types of gasoline (Regular, Midgrade, and Premium). Whatever the case, I know the places to avoid, I've never been screwed aside from pulling into a place and having to go to a different place - but I'm damn sure plenty of others have been screwed plenty. Especially if they do stuff like pay with a debit card. Honestly, I haven't carried the amount of cash to fill up my car in years. I keep a $10 in the glove box in case of an emergency (empty tank or something).

Most of the stores around me that do it simply say "Credit $x.xx Cash $x.xx"... First off, what the fuck is debit? Last I checked, a debit card would constitute as cash, but apparently not!





Example, but not quite on par with what I see. Where I live it's much more deceptive. Much smaller writing.


Saw these starting to pop up at gas stations in the past few years...why is it just there that this is happening? Regardless, I immediately stopped going to the two stations in my area that do this.

As others have said, any business that takes a credit card loses a small percentage of money. They have to pay the bank of Visa or the bank of Mastercard a tiny fee just to use them.

So actually you've been getting a bargain up to this point. The stores have been losing a bit of money.

that's false. A very good friend of mine has ownes a Phillips station for 25 years. I came very close to buying it and looked over his books in detail.

Fyi, if a station is late one time on paying they get switched to COD. Thats a death sentence for C &C operations.

Maybe not all of them, but it frequently happens, including a Shell where I worked in my student days. That was in Australia, admittedly, but my understanding is that it happens in many countries. Margins on fuel, even if you do in fact have one, are too small to fund a (staffed) station these days

What grinds my gear is ones that do it by bundling a car wash and making the /w car wash micro font size and putting the non wash price hidden in the corner.

I also won't buy from gas stations with a seperate cash price. Luckily, none near me do so.

But when you see something to the tune of

Regular $x.xx (Credit) <--- This is where you expect to see Mid-Grade
Premium $x.xx
Diesel $x.xx

You are in your car and looking at small text from a distance. Also, debit also constitutes as "credit" - even though it is NO WHERE near that meaning in the business world.

Lol I'd love to see this get smacked down in a court room. You dont have a leg to stand on. There is nothing deceptive about this form of advertising. Its spelled out clear as day what the vendor is charging.

I patronize stations like this as well as any vendor who offers a lower cash price. A discount is a discount, I'm not picky.

Processing fees do not come to 6 cents per gallon. That's just excessive. But it is their right, and it would be my right not to patronize their establishment.

Yeah it's BS. Just pay the stupid fucking 3%, Habib. Don't pass that cost down to your customers. Amazing that they stay in business vs gas stations that don't pass the cost down to customers and still maintain the same gas price or cheaper.
