this samsung cell was out before the iphone so if anything the iphone copied samsung.phones evolve and the galaxy line would of eventually ended up they way they are today even if there never was an iphone made

and here is the samsung after 5 years evoling its design with the gs2.

The photo claim is wrong that the F700 was shown in 2006- but it is true that Samsung applied for a design registration on it in Korea in Dec. 2006 a month before the iPhone was even announced, so there's proof positive (besides the obvious that they didn't come up with it overnight) that it existed prior to Apple showing the iPhone. Of course, all of that was among the evidence that judge Koh threw out of court.

Oh, and by the way, Apple claimed that Samsung copied them with the F700 as well! (Even though that's not even possible!) So for those saying it doesn't look like an iPhone... well, Apple disagrees with you. Of course, we've since learned that everything rectangular, black/grey/white/silver/red/anycolor with rounded edges/with a screen "looks like an iPhone."

Pretty good write up here about how the F700 evidence was tossed out and kept out by judge Koh.

The judge's exclusion of evidence on independent creation meant that even though Apple was allowed to inaccurately argue to the jury that the F700 was an iPhone copy, Samsung was not allowed to tell the jury the full story and show the pre-iPhone design for that and other phones that were in development at Samsung in 2006, before the iPhone.

how can the judge throw that out is beyond fair...samsung will take this to the supreme court and have a real case not done in apples back yard.

10 bucks says the jury already were going to vote against samsung before the trial even started.

apple has painted samsung as being a copy cat and is slandering there rep and even in europe a judge ordered apple to put on there web site for 6 months that samsung did not copy them.

now they are going up agains the nexus that uses pure android os and has nothing with samsungs touch wiz ui installed and runs vanila android,does apple think they can tell google to stop making phones also?

this is just getting started and google bought moto just for its 17000 patents they hold and will fight back.

they already filed to stop apple from selling the iphone 5

the jury has already goofed up a few times and went threw what 700 pages in less than 2 days?

one guy even said they need to punish samsung and even in the papers it said not to punish and just to sue for actual damages.

what other proof do you need when a few lawyers said it should take 2 weeks for a verdict to come out and they came up with one in less than 2 days.

its like they were just checking yes for everything apple.

A Samsung statement makes the claim that Apple attempted to do that, but I can't find any evidence that Apple actually said/did that. Are court transcripts available or is there any other evidence to suggest that Apple actually did claim that "that Samsung copied [Apple] with the F700 as well!"

It may be that Apple did attempt to make it appear to the jury that the F700 was based off the iPhone design when it was, in fact, not, but I would prefer to have more concrete evidence that this occurred. The only place I've been able to find any evidence of this is the same quote from the same Samsung release.

Because Samsung's lawyers didn't submit it as evidence on time. Really it's their own fault.

If it's not true, I'd think it would matter a whole lot. For all I know it's something that got mangled in translation and doesn't represent the facts.

If that were the case, why were there a lot of internal Samsung documents essentially stating that their phone designs should be modified to be like Apple's? At this point it seems almost silly to dispute that Samsung was heavily influenced by the iPhone. Whether they should be subject to a fine for emulating it is another matter altogether, but it would be impossible to deny that that was Samsung's aim.

Honestly, even if the F700 were included in the trial I don't believe it would have changed the outcome. It wouldn't have invalidated any of Apple's design patents and the phones which Apple alleged infringed on their design patents look a lot more like the iPhone than they look like the F700.

The whole entire apple v samsung trial is a farce with a biased judge and ignorant jury that was led by a foreman with ulterior motives because he himself is a "patent" holder that benefits directly from samsung's loss.

The whole thing will be thrown out on the appeals court if koh doesn't throw out the jury's decision in september (or was it december?).
