Hey, I don't drive drunk. I don't even drink anymore.

Just because I disagreed with a guy who was bashing all drinking/driving does not mean in any way that I like to drink/drive.

And since I not only drive but race my car, I'd like to think I have some skills. Throw one of these soccer moms on Watkins glen and see how they perform. I may not be anywhere near Schumacher, but I'm not a Civic driving punk, either.

If they didn't administer a field sobriety test in addition to the breathylizer then this is one of the most bulls%$# situations I've ever heard of. The reason why you're supposed to administer field sobriety tests is because not everyone is impaired at .07 BAC. Assuming we aren't missing any key information this is crap. Just another victim of overzealous MADD-motivated crap.

I'm not saying there don't need to be more tough laws against DUI, but this is not the kind of situation that demands tougher laws. This is someone who was under the legal limit and was able to drive home just fine. Otherwise he would have been pulled over for reckless driving, not a "broken" tail light.

One should not drink and drive. Drinking does not make you a better dancer nor does it make you a better driver (and it clearly makes you worse at both).

In California, you cannot drive with a BAL of 0.08 or higher (makes you DWI). However, you also cannot drive if you are "under the influence" of alcohol. So, one CAN get a DUI while blowing a 0.07, or lower, if the officer believes the driver is under the influence.

There are reckless driving tickets (around $1,000 and a night in jail). If you are driving reckless for whatever reason (including drinking), you should get charged with reckless driving. I'm not at all a fan of drunk driving, but I think I have to side with the driver here... the police didn't pull him over for driving all over the place, they pulled him over for a busted tail light. The fact that he had had a few was just a bonus, and especially since he was under the legal limit there's not reason they should have charged him.

You need to get in touch with reality, and you need a ban for personal attacks.

People drink 1 or 2 beers and drive perfectly fine and unimpaired all the time. Hell, tired driving has been proven to be much worse than even very drunken driving. There is a reason that .08 is the legal limit, not .00.

i agree.. and if you are racing someone onthe streets, and get caught, it should be reckless driving, or speeding, but not 'racing'..

its like if a white guy kills a black guy..but gets an extra charge added to it, hate crime,

And on my side, I'm sure I could say DIAF to you for buying into MADD's propoganda like a fool...but instead I will try to educate you a little bit. If you look at what they count as an alcohol-related accident, you will be surprised. Drunk driving accidents are hyped WAY more than sober driving accidents. You are way way way way more likely to die in an accident involving a sober person and they happen way more often (probably because most drivers are sober), BUT...why don't we ever hear about them? Simple. MADD and the government work together to hammer "Drinking and driving is the worst thing ever!" into our brains so that MADD can retain power, and the government can retain all that extra revenue they rape out of middle/lower class americans who have not harmed anybody.

I agree. Also, I agree that .08 is much too low...and that we are using way too much police power to try to catch social drinkers. A girl was just murdered in my city while the police were probably out looking for some nice guy who had 3 beers at his friend's house.

if you drive after drinking, you're an ass and deserve to get caught. it doesnt matter if he didn't hurt anybody, it only takes one mishap for them (and their victim) to become just another statistic.

You all need to lose a couple family members or friends to impaired drivers.... It will change your selfish and blatantly lame views on driving.

I drink alot and love it... BUT I will DIAF before I hit the road with anything more than stone soberness.... out of respect for the ones in my life that passed much too early due to impaired driving.

Driving is a ****** privlege.... you get to move a couple tons of machinery around at insane momentum without having to pass any real test.... but then on top of that you want to be impaired while doing it? F off.

The fact is that legal limits have been set by people much smarter than you. If you're under the legal limit, it's legit. No laws have been broken here.

You're making a judgement off something that happenened. The sample size is 1. I'm sure people have been killed by old people, or people talking on the phone, or people driving blue cars. That doesn't necessarily mean that that's the cause of the accident.

Maybe you should push for a more strict driver's exam. However, until then, drunk driving is still illegal. Is it possible that when he started the drive he was at .08 or more? Or could he have gotten to that point if the drive took longer? At that point, as people have said, it's the officer's discretion.

Your ignorance to this by calling him an idiot just makes me think you haven't realized that drunk drivers are more likely to cause wrecks than anyone else on the road. Why the need to insult? Are you THAT upset by someone not liking drunk drivers?

Don't compare it to other bad drivers. It's not a pissing contest.
