Can't the bank where the check was deposited simply say what account number the money ultimately ended up in? I mean they have to have records of that stuff right?

They do, but they won't tell Tango, and the LL isn't doing squat. So while he is sitting there doing nothing, saying he didn't get his check, Tango is doing all this legwork (for what seems to be no reason at this point, I might ad.)

LL needs to sit down with his bank and get the answers. Tango has provided all the information that is needed for the LL bank to research the issue.

OP are you paying $2500 a month to rent? Holy fuck that's a rip off if true. You can rent beach houses in the outer banks for that much.

If the LL lost the check and it was picked up and deposited by someone else then the LL will not be able to do a thing about it.

You might be able to get your bank to do a stop payment but it's probably too late.

Ultimately he 'received' the money and then lost it. How is he going to handle not getting rent for that month? If he's already having $$ issues this may turn into a big deal.. Keep us posted..

Right, but if the LL is being so difficult, the headshot in all this would be: The bank where the check was deposited said the money ended up in account xxxxxx. That is your account. Deal with it. That would basically end it all.

You might be able to get your bank to do a stop payment but it's probably too late.

My bank has said the check has already cleared and they cannot stop payment on it. Had my LL been upfront when he first realized that it was lost/stolen I could have put a stop payment on it. Instead he chose to lie to me and say that he never got the check all the while someone was able to cash and deposit it.

Whether or not any of the banks involved: citibank (mine), HSBC (his) or Chase (lost/stolen) are able to recover the monies and put them back into either mine or my LL's is really not my problem. I got the LL all the information he needs to start that process and I no longer need to be involved.

I'll update the thread in a little while I got a meeting to go to.

Right, but if the LL is being so difficult, the headshot in all this would be: The bank where the check was deposited said the money ended up in account xxxxxx. That is your account. Deal with it. That would basically end it all.

Based on Tango post above, it seems if there is a third bank involved.

Chase will have to locate the deposit within their system and find out the relevant account.

Unless the LL or wife happens to have a Chase account. Then the tale gets even darker.

I'm not sure if you read the entire post but all of those questions have already been answered.

The check was signed by the LL with his account number and deposited. The check has cleared my account. LL tells me its not in any of his accounts. While I know this is not my problem I was trying to help out and get him some more information from my bank. At first he blamed me and lied about the entire situation so I am done trying to help.

The check image has been sent to the LL

I told him if the monies are credited to my account then I would write him a new check but nothing before that.

The purpose of the thread was not to try to get out of any lease. The purpose was to find out exactly what was happening. As the events unfolded we got more information and found out that he lied about the entire situation. Since the thread is pretty long I'll do a little recap here

I mail out rent check on 2/25 with a post date of 3/1 on check. Since February is a short month I wanted the check to be there early.

LL sends me text on 3/5 saying he hasn't got rent check yet and if its not there by 3/10 then he will charge me a late fee.

I check my bank account on 3/6 and see that the check has cleared my account.

I text LL telling him he must have got the check because it has cleared.

LL tells me that he still never got it. I show him the check image and he admits that it is his signature and account number on check.

After many calls to my bank to find out what is going on I realize that something is fishy with his story

LL admits that he got the check and wife tried to deposit it on 2/29 but bank would not allow it because of the post date. His wife either loses the check or it gets stolen. LL decides to lie to me and say he never got it in hopes that I would send him a new rent check.

There have been many many issues between the LL and myself. If you would like me to post them all then you can see all the crap that we have been dealing with over the past 9 months. So don't accuse me of starting this just to get out of the lease. We were already in the process of finding a new home before this garbage went down.

I cannot trust this guy any longer and don't feel safe in this home thats the bottom line.

So this is what I am thinking about sending the LL

Chris, I won't be able to go to the branch on Monday. I think I have helped you more then enough. I have provided you with the information to which bank received the check. It is now up to you to do the rest. You admitted to having received the check on or about 2/29/2012 and tried to have it cashed that date. If the check was lost or stolen while it was in your possession then that is something you must coordinate with all the banks. I would also suggest contacting your local police department. I do not appreciate being lied to. I do not have any more time to deal with your issues. It has become a major inconvenience. I'm sorry but I am done. Best of luck to you. Have a good day.

I would definitely send it. It's not your problem.

i would send this. he had your check, your check got cashed by his wife but somehow the funds went someplace else. its not your problem and have done WAY more than you need to do in this.

huh? What exactly am I being vague about? I posted word for word the text exchanges. I explained that we were in the process already of looking for a new home which would mean we would break the lease early.

This situation is just the cherry on top.

I'll explain our situation with the home and LL with some pictures as well. This is going to be long.......

My wife and I purchased a condo back in 2006 since then we outgrew it. We now have 2 kids and looked to sell it. Thanks to the housing bubble burst we weren't able to sell our home and did not want to do a short sale or just walk away and have it go into foreclosure.

We decided to rent the condo out and in the mean time look for a place to rent ourselves. After seeing around 25 different homes and apartments we narrowed it down to 2. We ultimately picked this house because it was on an acre of land, had tons of storage a basement that could become an office/man cave, a pool and a playground that would be nice for our kids. The LL had the same setup of kids as us - a older boy and a girl. None of the rooms would need to be painted, etc.

In the meantime we found a nice lady to rent our condo. She wanted to move in on July 1 which meant we had to be in our new place before then. So during our negotiations we had to be in by June 30 the latest. The LL said they were going on vacation that week and it was going to be tough for them. The LL did assure me that it would work so we signed on with them. The LL did say that they were in a similar situation. They were renting this home to us, renting a place of their own while their new home was being built. They asked if they could just store a couple of things in the basement (golden tee arcade machine) and a treadmill until their new house was completed in May. We didn't seem to have any issues with that because #1 I loved playing GT in college and thought it'd be cool when I had friends over and #2 my wife wanted to work out after our baby was born.

Fast forward to move in day. I stayed with our movers at the condo to assist them in getting everything into the truck. My wife (being 8 months pregnant) went to the house to clean it since it was going to be empty. When she arrived the LL and his wife were still there packing up. My wife was trying to clean as the LL & wife were leaving but it was impossible. They were never able to get everything out by the time our movers arrived. Our stuff get mixed with their things, etc. To make matters worse, the LL's brother in law was living in the basement and he had NOTHING packed. He didn't hire movers and was trying to get things out and loaded up his tiny Jeep wrangler that probably could fit 3 boxes at a time.

Garbage on side of house



Eventually the LL & wife got most of their things out of the house by 8pm or so. They left all their garbage on the side of the house and left their fridge filled with food. We asked them what was going on with the food and they said we can keep whatever we wanted. They left the garbage for us saying they didn't want to leave it by the curb all weekend long.

Now, when I talked to our lawyer he asked why did we "accept" the house with all of this going on. We explained that our tenant was moving into our home the following day and that would leave us with no place to go and a truck full of our things. Ultimately the LL left us in a shitty situation by agreeing to be out of the house and not being able to fulfill that agreement. So the basement was filled not only with the golden tee and tread mill but with tons of their things. It probably took a month for them to get everything out.

So we are in the house a couple of days and I went to the backyard and see that they let it go. They left rusted, broken lawn furniture laying around. They had a bike with no tires thrown in the woods, a pile of wood by the house that was infested with insects and the pool area was like Jurassic Park.

I asked the LL what he planned to do with the furniture. It wasn't like it could be used. You would put a paperclip on it and the furniture would crumble. He eventually called a got junk company and they came and got it. However, he left the wood. I asked what the wood was for and he said it was used for a fire pit that he took with him to his new home. He told me to get rid of the wood if I didn't want it there.

After my daughter was born in August I had some free time to get in the backyard and start to weed out the pool area in hopes to get it ready for the following summer (2012). It took a couple weeks but I got everything nice and clean.

So things are looking up for us......then we started to notice some more problems.....

The basement was 85 degrees and even with the windows open we couldn't cool it down. We had a couple fans running and unless you were directly in front of one you'd sweat your balls off. The basement had this nasty smell and if you stayed down there your throat would start to tingle.

I called in a company to take a look and they told me it was infested with mold. There had been multiple floods down there and the carpet had gotten soaked and filled with mold. The company gave me and estimate to have it removed to which the LL said he would remove it himself.

The metal baseboards even had mold growing on them....dust had accumulated and then mold was able to grow on top of them



The mold removal company told us that the carpet really had to be taken out in sections and not ripped out. The spores could get airborne if the carpet was just ripped out and get all over the house. The LL assured me that would not be an issue and his guy just ripped out the carpets.

Shortly thereafter my son got rashes all over his legs. He would take baths downstairs because that was the only bathroom that had a tub in the house. My 6 week old daughter got a mystery illness and had to have a spinal tap done. To this day the doctors have no idea what cause it but we all guess that it may be from the mold.

We had an infestation of cave crickets in the basement



My wife and I would sit on the deck during the summer to take in the sunset, etc. We would find ourselves attacked by mosquitos. We tracked them back to the pool which has stagnant water sitting on the cover. The pool hasn't been opened in 3 years so who knows what is living in there. The LL called someone out and they cleaned the top of the cover and got rid of the water. It cost the LL $200 and he said he wouldn't do it again.

This is how it looks now





6 weeks into living in the house we got an oil delivery. 100 gallons at $4/gal = a nice $400 bill. There is a thread about this issue as well so check it out. We basically got forced into accepting their oil contract and are splitting the difference between their contract and a COD price.

Some of the lights no longer work in the kitchen and the lights under the cabinets just fell out.



We had rubber bins with our summer clothes in them that we wanted to put in the attic. I go up there and there is tons of the LL's stuff. I asked him why was their stuff still up there and he replied "I didn't think you were going to use it". We finally were able to get them to come by and take the stuff down to which they just moved it out to the shed.

The shed with all their stuff in it. Not a single thing in there belongs to us.



I had asked the LL to work with us. He could keep some things here but give us a break on the rent. I really didn't care $25-50 month and we would have been happy. He said no.

Then we had a hurricane hit NY late in the summer. There were broken down trees, branches just crap all over the place. Our lease agreement said we were responsible for mowing the lawn yet he claimed that we had to take of landscaping. There is a thread about this so if you want to read more just go there. I did the entire cleanup by myself. I used 2 contractor boxes from costco in the cleanup. I think it came out to 64 bags.



Then we started to have issues with the washing machine. The water would just pour out of one of the pipes. I contact the LL and he basically ignored me for a month. I took some videos and sent it to him. He then realized it was a serious issue that would eventually result in having the cesspool replaced.

The cesspool collapsed and they had it replaced. The playground was torn up and the LL assured me that they would fix it once the weather warmed up.







When all this stuff was going on with the LL I asked him about the backyard. He tells me that he called his landscaper and that they wanted to wait a couple weeks for the weather to warm up. They didn't want it to freeze.

No freezing temperatures in the next 10 days



So these are the issues. I hope its not too vague for you.

I have not sent it yet. I plan on sending this in the next 15 minutes or so. I spoke with some family members and my lawyer and they agreed on editing it slightly.
