This thread is being sidetracked a little bit so I want to get it back on course. Lets be clear with a couple of things.

I have not made any demands with the LL. I was simply stating that my family has a lot of money invested into the property. Whether we stay or move really is not the point of the thread. I posted the other issues we were having with the LL to show the underlying problems.

The point of this thread remains:

LL had the March check in his possession when he lied to me about not getting it. That set off a chain reaction of consequences we are now in. I have been advised by numerous people that I am not in the wrong in how I dealt with the situation and I am clear. I have tried to work with the LL through the issues but he choose to decline my proposals.

What we have now is a detective investigating on the LL's behalf to find out who deposited the monies. After the investigation completes the LL will have the option of prosecuting the person who falsly deposited the check. This situation is clearly now on the shoulders of the LL and I am not required to do anything further.

How my family chooses to go from here is NOT the basis of this thread and all comments regarding that should be refrained upon. If you want to troll me or this thread any further I will report you.

I have updated this thread on a daily basis and as the information has been presented. Thanks

Why would you invest a lot of money in a rental that you didn't agree with since day one?

Update 4/5

Got a phone call from the LL's wife today. Unfortunately I wasn't able to answer the call. Without talking to her I can only speculate as to what she wanted from me.

LL had someone come out and clean the water from the pool cover. I'm not sure if they tightened the cover since I had to leave for work before they finished.

I replied to the LL's last email stating that I received his latest message and someone would get back to him shortly.

Got a phone call from the LL's wife today. Unfortunately I wasn't able to answer the call. Without talking to her I can only speculate as to what she wanted from me.

You need to keep the correspondence written and recorded. Talking on the phone is always going to be a bad move.

I agree that is why I try not to talk on the phone. I like everything to be recorded so that it can be presented as evidence (if needed).

Just a warning: the LL can come up with any number of "damages" caused by you in order to keep your security deposit. Happens all the time.

Always document the condition of the property before you leave.

w/ respect to the security deposit;
You should do a walk through with the LL after you have all your stuff out.
Then get an itemized list of issues.
If you agree with an issue; then either you repair it or agree for the LL to repair it.
If you disagree; then handle it as you desire.
Either way; have the list signed and you address the issues that you agreed on. As to costs; what is considered reasonable and proper; recommend that at least 3 bids be documented.

Big time this. Also - I don't know if this is the case down there but I know around here that there is a tenant/LL arbitration board that will do final walkthroughs as a witness with you if the LL is not available. (I have no idea what legal legitimacy this adds though)

I imagine they play out like some sort of SNL skit

Today's update

Nothing new in regards to the check. According to LL the police are doing their investigation for grand larceny of the check.

Prior to speaking with the LL earlier last week he had expressed interest in inspecting the property as per our lease agreement. As the LL and myself work towards an agreement to end the lease I asked him if he still wanted to see the home. He responded no. My family was eating dinner this evening and all of a sudden we saw the LL's wife in the backyard taking pictures. According to the lease the LL may enter the property at a reasonable time but don't say no and just show up anyways. My wife said she saw the LL in the car while his wife was taking the pictures.

Yard could be considered to be treated differently than inside the house.

As long as they did not attempt to disturb you; you may be making a mountain out of a garbage hill.

TJ, I know that you know this, and it sounds like you're starting the process, but you *really* need to get out of there. With a quickness.

Not in a "They built our house on an Indian burial ground" kind of get out of there, but a "Nothing good can come of us staying here" kind.

His terms, your terms, *whoevers" (whomevers?) terms...cut your losses man. :\
