Sometimes a spouse will want funds to use for a purpose that is to be hidden (good/bad) from the other. Check was already a problem in the initial deposit attempt, so it cod easily get covered up.

An ATM would not allow more than a couple of hundred out for a deposit and if would be tagged as s drposit. So it more than likely was hand cashed. Pull teller records for the day at the branch and tben bank then can decide if fraud was involved and pull video records.

All you need to do, if desired, would be to take cancelled check to the local branch, have then sign for the check, give you a full copy and let the LL and wife get it straightened out. If both are telling truth, it is the teller fault for not having verified the customer. The bank will make it whole to the LL in that case.

Because a lot of business use online payments of some type or another. The last 2 apartments I've had are online payments, and my buddy rents a house from a guy and pays w/ paypal.

Those are in the very tiny majority.

The vast majority(95%+) dont take electronic payments or they charge absurd fees to do so.

I think I figured out what happened...and it's just speculation.

LL had wife deposit check
LL wife couldn't cash it on 2/29 because of post date on chk
LL wife loses check
LL says I'll just tell renter never got chk

I'm guessing someone found the chk and deposited it with his account number and signature. I caught him in a lie and he just keeps denying it

He likely lied about the post date story as well. Banks can cash post dated checks. Post dating does nothing, unless the recipient agrees not cash it before said date.

I called the bank again tonight to see if they could trace to where it went. The bank said it was deposited into the account with the number on the back of the check. She said it says deposit only on the check so its not like they got cash as well.

She recommended that I go to the branch and fill out an affidavit of fraud.

Bank says it's out of your hands. Go immediately fill out an affidavit of fraud and forget it. Tell LL you have nothing to do with it any more. Ball is in his court. It's all up to him. It's not your problem any more (after affidavit).

He likely lied about the post date story as well. Banks can cash post dated checks. Post dating does nothing, unless the recipient agrees not cash it before said date.

They can cash them, but some banks will occaisionally refuse to.

For rent this is still really common. Why would this even be a question?

Well, the average ATOTer is a multi millionaire. They buy their 12 room mansion with cash. So they never have to pay rent, or a mortgage even. I'm surprised the consensis in this thread isn't "who still makes payments on a house? If you can't afford it up front with cash, you shouldn't be buying it!"

i had that happen once , so i started fed ex'ing my check , it sucked paying $12 to pay the rent, but it was worth it so the douche nozzle couldn't give me grief

Don't have time to read the whole thread, and this may have been posted already. I don't believe any bank controls for the date on a check. Post-dating was a trick people used years ago to "pay" when they didn't have money, but it doesn't work because as long as the instrument is valid, signed, good account, etc., it's going through. You can check with your bank to be certain, but that's the what I have always been told.

From my BBT agreement:

14. POSTDATED ITEMS. You should not issue a postdated check. The Bank is authorized to
disregard the date which appears on an item submitted for payment from your account.
The Bank is not bound by notice of a postdated item. The Bank shall not be responsible for
paying the item and debiting your account prior to the date on the item, regardless of
whether or not the Bank has received notice of the postdated item. If the Bank recredits
your account after paying a postdated check you agree to transfer to the Bank all of your
rights against the payee or other holder of the check, and to assist the Bank in any legal
action taken against that person.

I havent used a cheque in 10 years. My landlord wouldnt even take a cheque.

Electric, Water, Internet, etc etc, just pay them electronically. WTF would you use a cheque?

Nobody I know uses cheques. I doubt anyone would accept them.

OP, your LL and/or his wife are lying to you. It's the only answer that makes sense.

For one reason or another they need some extra cash. Either they spent too much last month or one of them stole it from their joint account or they partied too hard, but something is wrong and they are in a bind for cash now.

He tried to get you to write him a second check after depositing your first one, but at least you caught his lie. He tried to send you on a wild goose chase tracking the check through your bank, probably with the hope that you would just give up and pay him twice. Now he is trying to get next months rent early since none of that worked. He sounds desperate to me.

Wake up and smell the shit. You've paid him already. Tell him your won't be his sucker and to solve his own money troubles. Stay firm and good luck.

This thread makes me love my landlord, I've never had a problem. Honestly, if you have proof the check was cashed and deposited into the account number which is his account... Then you're fine. He can make all the fuss he wants, but in the end you have proof of payment and it's up to him to sort out with his bank whether the deposit was posted in his account.

Same thing when you deal with companies that you've paid but the account isn't posted on their end (this happens often enough). You send them proof of payment and that's the end of that.

WTF is the big deal? lol. It's not like he can force you to pay twice.

We still pay our bills with checks. Snail mail is still around and works, what's wrong with it?

I don't use checks at retail stores, or to shop online. Just to pay monthly bills.

Email has it's place, for sure. I use it almost exclusively for business.

For a short personal message, I pretty much use text on the cell phone.

A written letter is much more personal for a longer message. Or a phone call.

I would pretty much never email important news to a family member for example. Only if I had no other way to convey the message.

Actual cards for birthdays and holidays are much better than electronic ones.

An actual card with a short written note and signed. Much better that someone took the time.

Amazing! Taking the time to personally send a message.

Thinking last night, there is one perfectly valid answer; having seen it happen. Rarer now that tellers are using terminals, but it still can happen.

The check had the proper account number on it for deposit - however, it was accidentally credited to the wrong account by the bank - simple little typo if no one is paying close attention.

So the amount of xxxx is now in person's B account instead of the LL account. LL is correct, the deposit never happened. The OP is correct; he sent the check to the LL and is cleared.

The amount of the check is such that it had to be a deposit transaction - no ATM will process that amount and return cash for it.

The bank needs to institute a search on deposits made that date and verify what account the funds were placed into. Then they send out apology letters when the funds are reversed into the proper accounts.

I still think this way but am open to new ideas. My wife pays the bill and I was curious as to how she pays them. She told me that she uses an on-line bill payer from the CU. She pays all of the bills while she sits on the couch in a period of 5 minutes.

So, to answer your question NOTHING is wrong with paying by cheque except that your time is valuable and pying that way takes a LOT more than 5 minutes. Paying by cheque also costs money in stamps and envelopes. The biggest problem with paying by cheque is the risk you take that your payment will be lost/late in the mail.

I like cheques but I love the ease/simplicity of on-line bill paying!

While there might be a teller error, given OPs stated history the most obvious cause has got to be his landlord with a history of regularly fucking up his finances has yet again fucked up his own finances. There's also a distinct possibility that Paladin3 is correct and they're trying to screw you. The OP was wise to tell him he doesn't have any more money to give him. I would have told him that even if I had a $100,000 in my checking account.

I'm betting it'll just show up in his account. Whether that is actually what happens or it becomes the lie he uses in the end who can say?

Even if you use an online billpay through your bank, they simply mail checks to small businesses and people like landlords. Unless it's a pretty large management company that actually has an electronic payment system set up.

Yeah ok. Like I really want to deal with paypal with any issues. I've been screwed by ebay/paypal too many times in the past to rely on them for any customer support.

I called my bank again and they said there is really nothing I can do. The check has his signature and account number on it. There is no stamp on it but the rep said that is because it says "deposit only" on it. I'm guessing that the deposit can still be traced back to a teller, atm or whatever but that would be up to the LL to check out.

I asked about the affidavit of forgery and the rep said that we cannot do it in this case. It would be used in a situation where someone got a hold of my checkbook and wrote out some bogus checks. In this case, he had the check in his possession, signed it and where it went from there is his issue.

I'll post any updates from the LL but I'm sure he is going to try some BS on me.

This thread makes me love my landlord, I've never had a problem.

In all the years I have rented properties this guy/house is the worst. The LL is some big shot wall street type....thinks his poop doesn't stink.

I'm sure if you search around you can see my other threads about this house.
