Confirmed with my bank. OP is fully covered. Up to LL to work with his bank to find the deposit.

That's really not a lot for rent sadly around here.

$1600 is ghetto for a 3/2 with garage.

My first mortgage in 1995 was $900 in a rather nice area here for a 4/2/2 on a half acre and on a nice canal.

LL: Ok good. They know it went to Chase. Now they can obviously tell that account is not titled Broleigh and account number doesn't match.

Me: That is all the information that I have

LL: They now know who to contact to get the money back. I am sure you can do it over the phone. But if you need assistance I can go with you Monday.

Holy crap, what is wrong with this guy??

At this point I would request a formal investigation be opened. That way everything is documented. If the LL is lying, he'll get brought up on charges of fraud.

Can you just tell him that you are done with investigating and that it's no longer your problem? He's just taking advantage of you at this point.

LL signed the check with his account #
LL can work with his bank to track down where the check went to.

It is possible that it was stolen; but the LL has to prove it by showing that it was not under his control when the check was turned over to a bank. (Note I stated a bank, not his bank).

LL can have his bank contact the OP bank to try to back trace the check.

Best for the OP to tell the LL that he is finished with this issue and the LL needs to work with the LL bank and/or the OP bank to identify the issue.

shit at this point i would call the police. then contact the LL with the number of someone at the police department. telling him you think someone is commiting fraud with your check.

i gurentee the fucker will find the money fast.

You've done a million more percent than I would have. Once the LL acknowledged receiving the check, trying to cash even though post dated and the money was eventually taken out of my account, we're done, have a nice day.

OP, you said you want out of the lease anyway and have the proof to do it legally... have you considered this might be about time to lawyer up?

Even if you still need a month or two to find somewhere better to rent, might be good to have solid legal advice on exactly where to go from here with this whole check thing. Even if a lawyer isn't working your case full time, I'm sure it would be pretty helpful for them to start framing the situation and legal argument a little in advance.

Right on man. Sucks he's put you through that but glad to see you finally telling him to go stick it up his bum. Sounds like he has done nothing but tried to get you to do the work for him. Which if i really hadnt gotten money i was supposed to I sure as hell would be at my local bank asking them questions. Then again i hate relying on other people and prefer to do my own footwork

Hope it all works out for you and there honestly isnt anything he could do. Thanks to him you already have enough info to show that you paid him and it was supposedly cashed into his account or whatever.

You need to file fraud charges; this guy is going to fuck with you again next month.

Also you need to find a way to document handing him the money; he's going to 'lose' the rent check to charge you a late fee.

Your bank has provided you with confirmation that his bank received the funds, the check has his endorsement and he admit he received it. At this point it's between him and his bank.

In a court of law it's going to be a hard road to prove that.

you are slightly wrong. while nobody will go to jail or charges filled. The OP really should be filling with the police.

why? to protect himself for next month and if the LL gets a hair up his ass and try's to evict him. While the OP is planning on moving anyway he does not want to have a eviction in his history.

a police report covers the OP's ass. not that they will do shit..

Right. The paper trail and history will build over time which can be used to counter the civil case when the OP breaks the lease.

Correct but there is no downside to filing a police report. It gives a paper trail for the OP's claims against the landlord if it ever went to court. Do you disagree?
