Crazies with too much time on their hands. Living in NY, I've met my share of lunatic landlords with no job, too much free time yet blessed with a few rental properties inherited from their straight edge parents.

Just reading this thread makes my skin crawl.

How would I go about filing a report? I don't want to call 911. I guess just look up a local police precinct and tell them what happened? I hope they have 30 minutes to listen to the story

I've had similar issues with a previous LL. We sent the check and the LL said he never received it. The LL threatened us with small claims court and eviction. Turns out the check was 'stolen' from the LL's mail box and cashed. I told him they stole from him not me and he's not getting another check. In the process of doing all the legwork for him like you're doing, I discovered he'd filed a report of stolen mail with the Postmaster. Case closed.

On a side note, I was returning home one day and saw him broke down on the side of the rode. I gave him a jump and he said, "I didn't think you'd stop." I said, if I was you I wouldn't have.

I hate renting and I hate landlords.

Thankfully, I've had great landlords for the past 18 months at the current house my wife and I are renting. I'll really be sad when we buy a house in the next couple months.

I'm sure they'll be sad to go, too, as they had lots of trouble finding people to rent this to. It wasn't that there wasn't anyone interested, it was mostly that nobody interested had any money for a deposit.

Right. The paper trail and history will build over time which can be used to counter the civil case when the OP breaks the lease.

im a landlord and i was supposed to have a 700 dollar check 10 days ago. it ruined my weekend plans... i know i make some money off that house every month but to me i would rather just have it sold so i dont have to worry about it anymore

There's a reason everyone else in the thread disagreed with you; You seem to have missed that the OP plans on breaking his lease and would like something to offer the small claims judge when the LL comes after him for it. This is the civil case I'm referring to.

Being a LL isn't worth the trouble unless getting money from many investment properties is your job. (even then I'd sell and find a better line of work)

Like most threads people tend to want to agree with the OP and believe outlandish things.

This whole thread makes no sense other than someone thinking a forum thread may be ammo later on.

This whole matter should have been a 30 min resolution.

After the LL admitted that the wife had received the check, I would have told him not your problem. They took payment and possibly lost it or the wife is lying. I would have told them to f off, not your fault.

Well if in fact it was never deposited, it would be the tenant's issue.

If it indeed was deposited, then the check should have been 'printed' and sent to the landlord.

If it was deposited in to HIS wrong account, then that is up to him to fix...according to the law, he received the money at that point.

If it was deposited in to someone else's account, then that is up to the bank to fix. Being he was the depositor, then he'd need to do the leg work. If in the end the bank refunded the tenant, then the tenant would still be responsible for re-writing a new check.

To me this all sounds like it's been made over-dramatic for the purpose of getting out of a lease. This isn't a Sherlock Holmes/Judge Judy situation, but one of picking up the PHONE and possibly mailing a letter/handing over a canceled check image.

Hmm My take. LL signed stack of checks hands to wife to deposit. Wife packs bags and takes stack of checks to bank and puts her account number on them and deposits them into her personal account then has husband served. Husband trying to trick renters into pulling cash back and reissuing rent checks to get money back from estranged wife.

Of course that is just the product of my overly wild imagination.

I'm not sure if you read the entire post but all of those questions have already been answered.

The check was signed by the LL with his account number and deposited. The check has cleared my account. LL tells me its not in any of his accounts. While I know this is not my problem I was trying to help out and get him some more information from my bank. At first he blamed me and lied about the entire situation so I am done trying to help.

The check image has been sent to the LL

I told him if the monies are credited to my account then I would write him a new check but nothing before that.

The purpose of the thread was not to try to get out of any lease. The purpose was to find out exactly what was happening. As the events unfolded we got more information and found out that he lied about the entire situation. Since the thread is pretty long I'll do a little recap here

I mail out rent check on 2/25 with a post date of 3/1 on check. Since February is a short month I wanted the check to be there early.

LL sends me text on 3/5 saying he hasn't got rent check yet and if its not there by 3/10 then he will charge me a late fee.

I check my bank account on 3/6 and see that the check has cleared my account.

I text LL telling him he must have got the check because it has cleared.

LL tells me that he still never got it. I show him the check image and he admits that it is his signature and account number on check.

After many calls to my bank to find out what is going on I realize that something is fishy with his story

LL admits that he got the check and wife tried to deposit it on 2/29 but bank would not allow it because of the post date. His wife either loses the check or it gets stolen. LL decides to lie to me and say he never got it in hopes that I would send him a new rent check.

There have been many many issues between the LL and myself. If you would like me to post them all then you can see all the crap that we have been dealing with over the past 9 months. So don't accuse me of starting this just to get out of the lease. We were already in the process of finding a new home before this garbage went down.

I cannot trust this guy any longer and don't feel safe in this home thats the bottom line.

i agree. i wouldn't either. As you said you will have to break the lease sometime (doubt many would blame you either). As such a police report will help IF he decides to sue (with his past history i would bet on).

doubtfull they do a investigation. But it will help in a lawsuit and it can't hurt you at all.

Why would you even consider calling 911 for an issue like this and why would you want to file a police report?

Has the LL responded to you last correspondance? If not ... just relax and go about your business. You have gone over-and-above for him ... the ball is in his court now.

go in. don't call 911 over something that is not a emergancy. You can even call the regular number.

Cool. I'll try and get over there soon. Don't think I can do it today....maybe tomorrow.

There are 2 other threads in the first post if you want to read those as well. I may just post some pictures of all the issues we had with these people.

Can't the bank where the check was deposited simply say what account number the money ultimately ended up in? I mean they have to have records of that stuff right?

They do, but they won't tell Tango, and the LL isn't doing squat. So while he is sitting there doing nothing, saying he didn't get his check, Tango is doing all this legwork (for what seems to be no reason at this point, I might ad.)
