i would not plea guilty just to remove the option of a death sentence.

if i lose, i'd rather die than spend 2/3 of my remaining life locked up.
(even if prisons now have cable and netflix)

Why choose life in prison over death?

I think killing someone is doing them a favor.

BUT the way our prison system is, life in prison isn't so bad either....

Even if I know the quality of my life will be reduced, I always want to live. I know I can find some joy in life no matter where I am. Hell, in prison I'd have access to most books, cable tv, college courses, etc.

The question I have is why don't we just do away with the life sentence and instead execute everyone who would have gotten life immediately? Ostensibly we're hoping that the people who are getting locked up for less than the rest of their lives will learn their lesson and not commit crimes any more. We still have hope for those people, but we can't say the same for the people who are locked up for life. Once we have decided to lock you up forever, we've basically decided that society is done with you right? Well, why not really be done with you instead of taking care of you for the rest of your life?

Not everyone is such a bad ass as yourself and can take being killed.

Also most people are betting sooner or later they will get paroled or an error in the case will free them.

During that time they are usually living pretty decently for their standards.

I don't believe you. I'm skeptical of anyone who says "I'd rather die than x" where x is grow old/life in prison/anything else that's not some form of horrific pain and suffering. The will to survive is a strong instinct, unless you suffer from depression or have some other form of psychological abnormality.

There was a meth head here that killed his drug buddy with a hammer for narcing on him to the cops. The judge sentenced him to life and the guy told the judge to just go ahead and kill me. The judge said I can do that and gave him the death penalty. The guy ended up fighting it for years using every appeal available until he ran out of appeals and got a lethal injection.

If you are innocent, maybe the next great crime fighting technique after DNA evidence will exonerate you.

I wonder if it was him, or his lawyers

Some people are scared to die.

But in California, most people on death row die of old age before they are executed so it's pretty much like life in prison.

Keep in mind not every prison is gonna have cable and netflix, that particular one uses TV viewing as a pacifier to probably hire less guards and in the end save $$, the inmates also have to provide their own TV's. I worked at a food distributor that serviced 2 prisons, the chow is cheap as heck, we used to make beef heart patties, 1.5oz and they would get 2 for a serving, it was a pain to get the patty machine adjusted to a small thin patty and I asked my boss why they didn't just give them one 3oz patty, he told me if they got two patties they felt like they were getting more. Once I was building an order when the loader came over and insisted I switch boxes of banana's he wanted them to be all the same sized, "they will have problems over there if one guy gets a bigger one" he explained to me..

Sounds like the kind of things people say about 2 and 3 year olds.

It was him.
http://www.clarkprosecutor.org/html/death/US/bishop1112.htm

Summary:
Bishop, Jessie Johnson, Marcus Gentry, and Ricky Myhand were riding around and drinking beer one evening. An argument began after Johnson accused Gentry of getting Johnson's brother in trouble with the law. The two exchanged words and then Johnson hit Gentry over the head with a hammer. When Gentry jumped from the car and fled, Bishop ran after him and took him back to the car, where he was hit and kicked numerous times. Myhand reported the killing to police and led investigators to the body. He was not charged. At trial, a forensic pathologist testified there were 23 injuries to the head, neck and hand produced by a blunt object, such as a hammer. Bishop told a judge at his sentencing hearing he wanted to be sentenced to death instead of having a jury decide whether he would get life without parole or the death penalty. Johnson, who was tried separately, is serving life in prison.

Bishop v. State, 812 So.2d 934 (Miss. 2002) (Direct Appeal)

Bishop v. Epps, 265 Fed.Appx. 285 (5th Cir. 2008) (Habeas).

Final/Special Meal:
3 pieces of pineapple supreme pizza, cherries and cream ice cream and four root beers.

Final Words:
"To Mark's family, I would like to express my sincerest apologies. It was a senseless act. It was a needless act. The world is worse off without him. To my family, I love you. It's going to be all good." He finished by referring to Obama, the Democratic presidential hopeful. "For those who oppose the death penalty and want to see it end, our best bet is to vote for Barack Obama because his supporters have been working behind the scenes to end this practice. God bless America; it's been great living here. That's all."

I agree, but if my boss tells me to find the same size bananas that's what I do, I guess when your locked up 24/7 trivial things matter, the prisons were small-margin accounts be we made it up in volume so it was important to keep them happy.
