So what, a year and a half later, the facts came out, and Manning's treatment has been ruled illegal by the military judge.

I guess all those claims "the government did it, so it can't be illegal" were wrong huh? Shocking news I know to some.

Lind found that Manning suffered illegal pretrial punishment during nine months in a Marine Corps brig in Quantico, Va.

Just what most of us said all along, and were derided for doing so.

You're correct, but you should also cite the rest of the judge's judge's ruling:

But Lind ruled that Flynn had acted appropriately to ensure that the brig staff followed procedures correctly and that they took the "high ground". She found that there had been no intention to punish the inmate on the part of the brig staff or the chain of command, who were motivated purely by a desire to ensure that the soldier did not harm himself and that he would be available to stand trial.

That being said, I'm perfectly comfortable with the 112 day reduction in his sentence, since the main charge he's facing of "Aid to the enemy" carries a possible maximum sentence of life in military custody without any chance of parole. Talk about your pyhrric victories.

And if he was ' aiding the enemy ' you guys should think about what that entails. If he was ' aiding the enemy ' it's only in showing some ugly secrets to the general public. The government doesn't want every average citizen to know they're overseas blowing up innocent people & children in wars that have no possible end.

Please acquaint yourself with article 104 of the UCMJ as this is the standard he will be held to in his court martial.

(4) Giving intelligence to the enemy.

  • (a) That the accused, without proper authority, knowingly gave intelligence information to the enemy; and

  • (b) That the intelligence information was true, or implied the truth, at least in part.

The person, even if a traitor, was mistreated and "heads should roll" for those in the chain of command in charge of prisoners.

Yes, that's what all developed countries should aspire to, as giving someone a fair hearing is for wimps. If the state/media says someone is guilty of something, who are we to argue?

And if saving money isn't the highest ideal we can aspire to, I don't know what is!

Look at this NYT article

Colonel Lind, the judge, asked a prosecutor a hypothetical question: If Private Manning had given the documents to The New York Times rather than to WikiLeaks, would he face the same charges?

“Yes, ma’am,” said the prosecutor, Capt. Angel Overgaard.

The New York Times and other mainstream publications published hundreds of the documents Private Manning is accused of leaking. The Justice Department is carrying out an investigation of WikiLeaks to determine whether Mr. Assange or his associates can be charged with a crime.

Media advocates say such a prosecution would be a dangerous precedent for news organizations like The Times that frequently obtain and publish information the government considers classified.

So basically ANYONE that leaks ANYTHING to ANYONE can be charged with the same crime. Think about how many people in the pentagon that have leaked something over the years.....they don't seem to get arrested now do they?

I think most reasonable people would realize the major overreach of that concept. So no more people leaking to the media of government coverups or other mistakes. Because if you leak anything that makes the government look bad, well, you are aiding terrorists. If you leak to make the government look good, you get a promotion most likely.

I think you're reaching a bit far for this. The question is not about anyone leaking anything to anyone. I think it was to see if the prosecution saw a difference between leaking to Wikileaks vs a "legit" member of the media.

He broke the law and is paying for it.

You take an oath and are entrusted with secrets. In his position; he is not supposed to release information jsut because in may conflict with his personal beliefs.

Agree. The people have the right to know what the government is up to. He exposed many secrets that the government had locked up and exposed just how corrupt the government is.

My problem with him is that he gave the information to assange, a militant anti-American nutjob and gave away information that put the lives of whistle-blowers in Afghanistan at risk and didn't care.

As well why did the new york times publish the information and not get punished like Manning? Why did they publish this but other stories?

Manning's lawyer is now saying Manning did it because he's gay and wanted to feel better about himself:

Excerpt- His attorney has also said Manning struggled privately with gender identity early in his tour of duty, when gays couldn't openly serve in the military. Those struggles led Manning to "feel that he needed to do something to make a difference in this world," Coombs said.
Maybe Benedict Arnold and the Rosenbergs were gay too!
It doesn't matter, betraying one's country regardless of the rational deserves the harshest penalties.

ezackly, hes a hero. the traitors who should be on trial are bush and cheney who got millions of people killed and injured for the profit of american corporations. its always amazing to me how easily people are fooled by creeps like that, all they have to do is start a war and 80% of the country immediately unquestionably supports it as if its their "patriotic" duty

Interesting I almost agree with you on something. But I'm dirty scumbag liberal who believes that generally information should be free. Are you a liberal to?

As for the NYT its very difficult to punish a paper for publishing material that was given to them. I believe that law was settled with the Pentagon papers case back in the 70s.
