Yeah, RICO is the massive sledgehammer, but this complex of a case I highly doubt it gets to trial before the 2024 election (and then the Supreme Court gets to decide if a state can continue to try/convict/jail a sitting president if Trump wins the election...)

He knows how to use social media on his phone. Need to cut that off. I need his ass bored at home and without a megaphone to the outside world. No attention from his fans, no rallies, no golf, no business meetings, no nothing. Just sit at home, watch TV, and eat hamburgers all day until his sad, miserable life ends in a poof and not a bang.
whatever that needs to be done I'm sick of seeing his name in the press.

It is not at all settled - the federal DoJ has an old policy that it should not pursue criminal charges against a sitting president based on an interpretation of immunity. But it has never been ruled on by the Supreme Court. Also, the DoJ policy only applies to federal criminal matters, is by no means directly binding on state criminal courts.

But given this particular Supreme Court, they would likely rule in Trump's favor given even the slimmest excuse, which the DoJ policy provides.

(edit: as a minor aside, under the DoJ interpretation, a president like Trump could literally walk into congress during an impeachment vote and gun down anyone he thought might vote against him, and he could not be arrested until after his presidency ended)

Typically, as I understand it, US Supreme Court can only review state cases to the extent they are related to federal law or constitutional law - the GA supreme court has final authority over interpretation of all Georgia law matters. (Note Georgia has their own version of RICO on the state books, so not relying on federal RICO statutes).

Trump would certainly still appeal to the Supreme Court if elected - trying to tie the case to Constitutional law (that the sitting president can only be removed via impeachment, and arguing that sitting in jail would certainly interfere with the exercise of his duties).

Trump "could get off" using delays, or with a co-conspiring future president like DeSantis, or by pardoning himself if reelected. However, and I still say this again, for people to just imagine the country with Donald Trump as president? Knowing all we know now, I can see no way a country ran by a Donald Trump would be functional. It just would never work.
Yeah, sure... Trump could run and get elected and could pardon himself, but what happens then? What happens after THAT? Seriously folks... does ANYINE actually believe it would be business as usual? The nation would have a felon as sitting president, a convicted felon representing the United States to the world. A felon meeting with world leaders and giving speeches at world events. Now seriously folks.... can you imagine that as doable? As acceptable? As tolerable ????

Presidential pardon powers don't apply to state charges. He'd have to get a Georgia pardon board to pardon him.


In Georgia, pardons are administered not by the governor but by an appointed state board that in the past has limited pardons to offenders who have already done their time.

All in all, Georgia is the last place in America where Donald Trump should want to face the music for his misdeeds.

I just don't know. I just don't feel comfortable believing the system will work or I should say the system will be allowed to work as democracy designed and intended. This is an important case against Trump, possibly the most important of them all because so many are involved, but the other side... the Trump side... that "organized" side referred to in the indictment are still alive and well. They still have the ability to derail everything and I believe they will come first opportunity.

This reminds me of the night when Richard Nixon tried to have his AG fire his special prosecutor. Nixon's then AG refused and resigned. Then, the next in line in the AG office also refused to fire the special prosecutor. Then finally it was Robert Bork that did fire the special prosecutor and this was called The Saturday Night Massacre.

I believe we will have another Saturday Night Massacre come October. It probably will not come on a Saturday nor at night, but it's coming.
The day or night in October when that new GA law goes into effect giving the GA governor the ability to fire the DA, the DA running the Trump indictment. And thus, ending the indictment, all aspects of the indictment, all 41 counts of the indictment.

This will be our Saturday Night Massacre. Equal to Nixon's Saturday Night Massacre. A massacre that lead to the impeachment of Richard Nixon thus forced his resignation. However, this time will be different. This time there will be no resignations nor concerns nor voices crying out for justice because the voices in the GA legislation have already spoken and those voices fully support and encourage the massacre.

I’ve heard that Trump’s attorneys will possibly try to get the Georgia case moved from Fulton County to Federal Court as they can possibly get it moved to a district with a more favorable jury (also…so Trump can pardon himself of ALL charges if elected.) But isn’t that also a greater risk? Wouldn’t that expose him to charges from Michigan or other states??

One of the reasons the GA case is so strong is they created a tough RICO law for their state. Not sure if this would be easier to try in Michigan.
