The judge in the case thinks there’s enough evidence to warrant a hearing and testimony on it.

"I think it's clear that disqualification can occur if evidence is produced demonstrating an actual conflict or the appearance of one," Judge McAfee said in Monday's hearing. "The state has admitted a relationship existed. And so what remains to be proven is the existence and extent of any financial benefit, again if there even was one. And so because I think its possible that the facts alleged by the defendant could result in disqualification, I think an evidentiary hearing must occur to establish the record on those core allegations."

I don't think you understand how things work. The hearing is most likely a findings of fact hearing, TO DETERMINE if there is enough evidence, not becaues he thinks there is evidence. It's kind of manditoary, as It's usually the first step in the process which dermines where things go from here. Unless I missed the finding of facts hearing, and it has already taken place.

Is there evidence for any of this? It's all incredibly far fetched. Like, evidence that this is a week case against Trump and the only reason they're prosecuting him is to profit off of the case. I can't believe people are giving that any kind of legitimacy.
It is far fetched. However for conservatives, since Trump is leader of the in group and by default has done and can do nothing wrong then those accusing him must have ulterior motives. This is an ulterior motive they can now hang their hat(e) on:

She decided to prosecute the innocent former President to get money for her lover to spend on her.

Looks what it takes to be able to find even the slightest bit of conflict vs the stuff Trump hits us with almost daily.

Just some perspective. Seems perfection is the standard for the left.

Dang the soap opera is really good. Wade and willis broke up; Willis wife has been living in texas and they got a divorce because SHE had an affair. .... lots of gossip - well not gossip since it is under oath.

Bonnie should have known better. And lawyers really look bad when they testify. Always, thinking a few steps ahead, trying to maneuver around questions lawyerly just doesn't fly. Except, this is in front of a judge. If it was in front of a jury, oh holy hell.

Normally a prosecutor gets a salary regardless of whether they prosecute or not, but in this case, he only gets paid if he's continuing to prosecute.
How the fuck.

That's one way to introduce corruption charges and tank the whole case / legal system. By not using people who are paid regardless. That is just ridiculous.

This is completely normal and has been used in thousands of cases nationwide.

I'm not caught up, but it seems like the case will need new prosecutors. In the biggest case of her life, DA Willis should have known better; when she was running for office she said she'd never date a subordinate.

Richard Fausset, Reporting from Atlanta

Judge McAfee has now issued a warning to Fani Willis, the Fulton County district attorney, saying he will strike her testimony if she does not directly answer the questions put to her by the defense lawyers seeking to disqualify her from the Trump case. McAfee formerly worked under Wade in the district attorney’s office.

Under aggressive questioning from Craig Gillen, Nathan Wade is trying to clarify a billing record that appeared to claim that he had worked 24 hours in a single day. He says he was billing for 24 hours of work over several days. “There was never a billing of 24 hours in one day.”

The defense lawyer Craig Gillen obviously wants the judge to find it hard to believe that Fani Willis repaid Nathan Wade for expensive trips with cash — and cast doubt on Wade’s claim that he has no deposit slips for the money he received from her.

“Do you have a little cash hoard in your house?” Gillen asks.

It’s definitely a problem, if not for legal reasons than for PR ones. That being said, I doubt she recuses herself unless somehow forced. The main reason is the board that would replace her is dominated by Republicans who would likely tank the case.

How many people on this disqualification case? Judge just banged through 3-4 because they said nothing relevant

At least so far this seems to be a lot of nothing, just a PR exercise for Trump. Guess we will see though.

Doubt judge will even need to take a day to give the ruling once all testimony is done. He only allowed this hearing for due diligence

This is my thought as well. I personally don’t care about what she did here, but how hard is it to put in the barest minimum of effort to be squeaky clean when prosecuting a historic case that will be in history books in 100 years? Now she (maybe) gets to watch someone else do it. Irritating.

Again, if she does that means the case is likely dropped. What should they do?

Obviously not drop the case, the whole “scandal” is a nothing burger to me. But I’m irritated anyway because she opened up such an obvious attack vector, right wing disingenuous nonsense or not.
I completely agree. What an idiot.

Usually it’s men who are too stupid to avoid this shit so double dumbass on her.

That's not quite my understanding, but AFAICT it's all in the hands of Judge McAfee now.

A few weeks ago, my reading was that if Wade and Willis preemptively recused themselves, the Fulton County DA's office would still be in charge of the prosecution. But per GA's strange laws, if McAfee takes her off the case, her office is dropped as well. This had already happened in a previous J6 related case where Willis was removed, and that case (Burt Jones) has been frozen ever since.

Even if this is a hail mary by the RICO case's defendants, it sure seems like it's worth it.

Like @repoman0 said, I honestly don't care who's fucking who but this case was a lot larger than soap opera nonsense. By a few orders of magnitude.

I am not a lawyer anywhere, much less a lawyer in Georgia but from my understanding if she removes herself from the case the people who choose her replacement is a Republican dominated board. They will likely choose someone who drops the case.

I could be totally wrong here and if anyone has expertise here I’m happy to hear it, but that’s my understanding.
