With all the stupid lawsuits like this one here, would it be better just to kill anyone who trespasses on your property?

Heh, this is like that other case in England where a lady was arrested after a burglar got cut up trying to go over her fence that had barbed wire on the top. The gov't in Britain is freaking nuts about NOT letting people defend themselves.

In Canada you can't use lethal means if somebody breaks into your house unless you have good reason to believe somebody's life is in danger. Dumb eh? It seems only common sense that if somebody breaks into your house in the middle of the night they should leave in a body bag. At least generally speaking (if it's daytime and a 12 year old and you're a 250 lb bodybuilder and beat him to death that's something else altogether).

Now in this case it looks like the soccer player simply restrained the guy and perhaps roughed him up a bit. I think he should be given a pat on the back.

I normally just shoot them, toss them in the wood chipper, then feed all the hungry forest animals...much easier this way

Sorry, but I'm not actually seeing a lawsuit here.
Merseyside Police are investigating the allegation and officers will speak to Ferguson. He will not be arrested but is likely to be interviewed under caution and with a solicitor present.

Lol, that happened about 15 miles from where I live.

Just like the farmer who killed a 16 year old boy 3 years ago when the boy (and his friend) broke into the farmers remote farmhouse in the middle of the night. The farmer woke to voices downstairs, sh!t himself (understandably) and shot one of the boys with a shotgun.

He's now serving life behind bars for manslaughter

It sucks.

Same is true in most states in the US. You, generally, are not allowed to protect real property with deadly force. If you are defending the life of yourself or another on the real property, then it is justified if you reasonably believe yourself or another to be in immidiate fear of deadly force. Some state have a requirement that if you are able to retreat out of the home you must do so, as deadly force is an absolute last resort. Others presume that if someone breaks into an occupied dwelling, then the reasonable fear exists, and you may start shooting away.

The reasoning is that real property can be replace, human life cannot. (Yet). Therefore, one cannot use deadly means to protect real property alone.

Do they give an award if you shoot the person in your house? Hehe. But seriously, some of these laws are just horrible. I intend to defend myself and my family by any means I have, especially if its the middle of the night and people are in my house.

DO:
1. Plant an object in the would-be burglar's hand. One that could easily be mistaken for a gun in the dark.
2. Piss on yourself.
3. Act real freaked out and scared when the police come.
4. Claim you saw the dead guy whip out a gun. You shot him "in self-defense."
5. Shoot him several times. Empty the clip/revolver. It shows you were panicked.

DO NOT:
1. Tell the police that you have a right to shoot anybody who comes into your home, even if it is in the middle of the night.
2. Brag about how you spend x hours a week at the gun range honing your skills.
3. Shoot him once. It shows you're still thinking rationally when you shot him.

My two cents...

do not empty the gun if it's an automatic. it's going to be kinda hard to explain unloading 15 shots into the guy, even if you paniced.

that why you should only have a revolver for home defence. much more believable if only 6 shots.

AND IF YOU DO KILL HIM, MAKE SURE HE'S IN THE HOUSE! IF YOU SHOOT HIM AND HE FALLS OUT OF THE DOORWAY, DRAG HIM BACK IN!

And one last piece of advice. DON'T SHOOT HIM IN THE BACK!!!!!!!!!!!!!!!!
