Of course it's not rape. It's rape if she doesn't want you to have sex with her (and tells you) and you force her to anyway, regardless of intoxication level.

according to what i am reading/hearing.... it depends on the level of intoxication. Many times the girl is considered incapable of giving consent and it is rape.

Take this for what it's worth (not too much ), but if I learned one thing in college, it's that banging random drunk girls isn't a good idea. Don't get me wrong, I'm in no way suggesting you not have all the sex you want, I'm just saying that college movies aside, there are plenty of other places to find it than with some drunk girl at a frat party...and it usually comes with a lot less hassle, rape charges and otherwise.

Of course some people like the whole drunk sex thing, so feel free to ignore me
