A jury will decide his fate - based upon certain criteria of self defense - was it necessary at that moment, did he truly feel in danger (or was he just angry), did he have the ability to retreat to safety, etc. My gut tells me his actions won't meet the criteria of true self defense.

Off hand I believe the laws in New York tend to be more stringent re: self defense, especially as this wasn't a home invasion situation. But absolutely being struck in some manner does not suddenly give you the right to wail on somebody with all your might. Unless you can convince the courts that your life or serious bodily harm is at risk, you better think before you act.

Some posters seem to be off the reservation when it comes to a reasonable response - if an elderly, handicapped individual strikes me in irritation, do I have the right to roundhouse kick him/her in response? Legally and morally NO - i can easily move myself out of "danger" and report the person to the proper authorities.

I'm willing to be proven wrong based on medical examinations of the damage both individuals took as well as video footage, but again I think it's unlikely he either took serious harm or felt at serious risk from her. Words were exchanged, they were both pissed, they *both* struck in anger, not self defense.

You should learn how to park. It's incredibly stupid to pull past your intended parking target and then back into it. That method was invented when there weren't many cars on the road. It's been decades since that method has needed to have been reinvented.

Good thing it has, eh? Pull front-first into the spot. It's safer, faster, and a hell of a lot more practical instead of seeming to the car right behind you that you are going to skip the parking spot, then suddenly stop, then have to back up into it when the car behind you is already right next to the parking spot, locking you out.

Don't be a dumbass. Pull head-first into parallel spots.

I live in Hoboken across from NYC and I drive a small car. It is impossible to park by driving in first unless 2 spots are open. You clearly don't live in a crowded area, the average space between bumpers of parked cars in Hoboken is about 1' (no exaggeration).

Regarding the article, the guy used excessive force and he also ran so he is done. However, it does seem like the woman started it so she is not guilt free, despite the fact that she ended up on the losing end of the confrontation.

and from that 2nd article, it seems like the guy really is remorseful and sorry, and he was defending himself when he hit her. she hit him 4-5 times, then he saw someone running at him, so he hit her and bailed. not saying what he did was 100% right, but it sounds like it is totally a far cry from what the first 5 pages of this thread are assuming.
