This one has me conflicted.

On the one hand, the libertarian side of me sees it as unfair to deprive someone of liberty for any amount of time without adequate due-process. I also believe in the inherent nature of government (the courts in this case) to abuse its authority if allowed- and currently all too many people are content even gleeful to allow it.

On the other hand there's the side of me that's sick and tired of the entitlement-class of this society that has ZERO respect for law and order and no respect for anyone else in the society. The type that flies the bird at any and everyone else all the time 24/7 and thinks everyone owes them everything. That side of me sees yet another of these type of throwbacks FINALLY after what's probably been a rotten lifetime of being nothing but a pest get just a tiny bit of comeuppance from a judge who refused to take the same shit she deals everyone else in society.

You should go back read what I posted, no independent court or judge is required for a presiding judge to hold a person in contempt of court and jail/fine said offender.

I dont negate this state of laws , i was just pointing
that in other situations than this one such a case
would be a blatant conflict of interests , that is ,
a decision is taken by a party that has an interest
in the outcome.

I m surprised that the US law can neglect such points
but i suppose that expeditive justice is the norm for

That wasn't her house, it was her grandfather's house. She assaulted her grandfather and the judge decided to protect him from further assaults. I don't know of any court where you can freely mouth off to a judge without repercussions.

While I completely agree with everything you just said, i do not like the fact that a judge can put a person in jail for a year because he doesn't like the way said person talked to him. That is just begging to be abused and is entirely too subjective for this sort of punishment.

I would love to see this judges sentencing record and what other crimes he has given similar sentences for. Lets say he gives someone who has committed breaking and entering the same sentence, is her pissing a judge off the same danger to society as breaking and entering (or whatever) and therefore deserving the same sentence? I personally don't think so.

That is not what is in question, the absurd term in which he evidently has the sole power to levy simply because he was insulted is what is in question.

Frankly, 30 days is long enough to let her calm down. If she comes back with the same attitude then fine, give her another 30. To hand out nearly a years worth of incarceration because she was insulting to the judge is imo beyond absurd. The judge should have simply shut her down long before it got to that point but the problem is that he got emotional as well. No one should face extended periods of time in jail due to a judges emotional response.
