Well, since after receiving the 30-day sentence, she continued acting out, I think that the longer sentence *might* get her to realize that she doesn't have carte blanche to say whatever she wants AFTER being held in contempt.

It obviously wasn't effective. So his question remains, after realizing that it wasn't effective what does a 300 day sentence do to help society?

The main point of a contempt sentence is a period of time in the slammer that forces the offender to think about what they've done (or haven't done, in cases where the judge is trying to force compliance with a court order) and (hopefully) change their behavior. But this judge seems to think that contempt sentences are punishment. Unfortunately, that's illegal under the due process clause of the Constitution.

No, the proper procedure is to give the woman 30 days, then bring her back and see if her attitude's changed. If not, give her another 30 days. At some point, a trial on the original charges will occur, with or without her cooperation, a verdict will be decided, and a sentence imposed if she's found guilty. At that point, any remaining contempt sentence becomes irrelevant.

And in this case shira has the correct answer.

After 30 days, if she still mouths off, send her off again. I have a feeling after 30 days behind bars her attitude would have changed a bit. However, a person mouthing off in court and a judge acting like a child racking up sentencing isn't solving anything or teaching anyone proper behavior.

So in this case they are both wrong. Difference is the woman pays for the judge being stupid instead of the judge for his actions.

I don't see the problem here, you don't talk shit to a judge in his own courtroom.

She'll get the initial 30 days, the rest will be nullified by judicial diversion, and she'll stand trial for beating her grandparents. How she thought she could go back to the scene of the crime, after what she's been accused of doing, is beyond me, and likely the judge too. That's one incredibly stupid person.

And society would certainly benefit from someone like this chick with obvious severe impulse control and anger management issues being locked up for 300 days (probably much more once she's convicted of assault). Her grandfather certainly will.

Hey, I'm not saying she's not a douche. That is WELL established. I am saying the judge overreacted as well. It doesn't matter how much "shit" he puts up with every day. That is his job he chose. He either can deal with it or not. If he can't deal with it, then he needs to find another line of work.

Instead of dragging it on for 10 months; the scenario was condensed into 10 minutes.

The lady should have listened.

Yes the initial 30 may have been a shocker; but a smart person will listen and understand what goes on in the courtroom.

The 30 days would have been waived if she had then kept her mouth shut and apologized.

She chose to ask for another 30 and the judge granted her that request. And again.

Some people do not understand it is better to keep your mouth shut and be thought of as a fool than opening it and proving you are a fool.
And there are supporters that feel that acting/being a fool/idiot should have no consequences.

Everyone in her life looks the other way when she acts out, many likely encourage it..

It's likely that she grew up seeing her mother act this way to get what she wants.

In Chadwick v. Janecka (3d Cir. 2002), it was established that contempt of court can be any length of time (in this instance, the person was in jail already for 9 years at the time of the case, and was finally let free after 14 years). If someone feels like continuously smarting off to a judge, then there is no limit as far as how much time the judge can give them.

The reason contempt of court was put into law in the first place was so that the courtroom didn't have to deal with people trying to impede the regular functioning of the court. If contempt wasn't a rule, people could sit there all day and talk smack if they wanted and the courtroom wouldn't function smoothly because it would be held up.

Therefore the onus is on the person appearing before court to behave themselves. The person gaining time from contempt of court really has nobody to blame but themselves; if they're too stupid to not keep mouthing off, then the increasing jail time is their fault. Blaming the judge because someone can't find the means to control their temper is ridiculous, especially when it's so completely trivial to avoid contempt simply by keeping your frigging mouth shut.

Instead of the judge putting her in jail she should have been given a taxpayer funded stay at the Hilton while the restraining order was in place, since she had no place to stay
