<< NEW YORK (AP) ? A woman is suing a snack food company for $50 million (U.S.), saying its label on Pirate's Booty corn and rice puffs derailed her diet.

In her lawsuit, Meredith Berkman, 37, claims she suffered "emotional distress" because the snack contained three times more fat than its label advertised. Berkman said it caused her "weight gain ... mental anguish, outrage and indignation."

Pirate's Booty, manufactured by Robert's American Gourmet Food, Inc., was recalled in January after the Good Housekeeping Institute found it contained 147 calories and 8.5 grams of fat, while its label said it contained only 120 calories and 2.5 grams of fat.

The company claimed the discrepancy was a result of new machinery that changed the nutritional information on three of its snacks ? Pirate's Booty, Veggie Booty and Fruity Booty.

A message left at the company's headquarters was not immediately returned, but a statement on its Web site said, "These changes have made Pirate's Booty a more consistent and better snack."

The new version contains five grams of fat, which was verified by Good Housekeeping. >>

If I were the judge I'd definitely find in her favor for false advertising. I'd award her a refund for the MSRP of the bag, $1.99, then proceed to fine her $10,000 for court fees.

Cool your jets... Remember ANYONE can sue ANYONE for ANYTHING. Doesn't mean she will be awarded a penny. She has the burden to prove that this error caused her the mentioned problems. This could have been a problem for someone else though. Not reporting or misreporting the nutritional information could cause some people allergic reactions. A lot of foods have peanut oil or peanut products added for consistency that can cause severe reactions. If this was the case and she was intubated then i could see her owning the company in a month or two from the lawsuits. On the other hand what kind of diet is she on where she is consuming that kind of quanitity of snack food. That is proof in itself that she is not serious about this diet. That one snack of hers was 2.5 G of her allowed 13 for the day. Thats a lot for a snack.

My faith in humanity goes down a notch everytime I hear stuff like this. Some people drink sh*t water, but *these* poor souls ate 40 big macs a day and got fat. Whinny 'povs'. :|
