All of you that answered "yes" are just asking for domestic violence charges. That's all hitting back is going to get you. Is that worth it? No.
Not likely. Once someone, ANYONE, attacks you, you have the absolute right to defend yourself from harm. If you kick her once she's down, sure, you'll garner an assault charge. If all you do is strike to stop the attack, nope, you're golden.
In theory. In practice, unless you have it on video, she is gonna tell the judge you started it, and judge is going to belive her.
Not with my record and experience.
Fight starts, I try to restrain or avoid (which honestly I'll be successful at). But even if I wasn't, and had to put her down, I'd do it using a correct method. Then I'd stand up and call 911, tell them I was just attacked and had subdued the attacker. Then I'd send someone out for the theater manager, explain the situation and get him to stop the film (which they will do when there's going to be police in the house). Then I'd inform the audience to not discuss what just happened with anyone around them until the police had taken their statements. Then I'd use my phone to make voice memos of what had occured for later recollection. When the police arrived I'd explain the situation, request copies of all statments taken (which I would demand if they weren't initially going to get them), an incident number, and off I'd go.
In court, I would win. Because that's how I've handled every assault I've been involved in and no one has EVER successfully sued me. Experience counts for a LOT.
