Yeah, there's a thread on this in the dreaded P&N. I'm at a loss to explain how this is legal.

Well, after you get out of the military, you're still in the Inactive Ready Reserve for a certain period of time. I think if you were to serve only one term, the perioud would be eight years.

well unless they are hard up for soldiers then there is no reason for them to take him.
IF the army is that hard up then they should increase the pay of the soldier.
anyway i think the guy won. I seem to remember seeing this in the news a few days ago.

You're thinking of a different guy, who did in fact win.
The problem here is that, if the Army is really trying to grab this guy, they appear to be doing so illegally. My guess is that this is a misunderstanding, but I guess we'll see . . .

If that soldier was an officer, there is no limitation as to when they can be called back into active duty.

I don't believe that's true, and I am an active-duty officer.

Unless they've changed the rules since my husband retired (always a possibility), an officer who retires and is getting a pension can be recalled up to age 60. He has been retired for 13 years and has orders requiring him to report to Ft Gordon if mobilized. But, as husband says, it would take a monumental decimation of forces before they'd ask for the old geezers like him to come back.
military members who have been discharged from the Army, Army Reserve or the Army National Guard, but still have contractual obligations to the military.

WTF kinda bull sh!t is THAT!?
As I understand, only commissioned officers have further obligations after release from reserve duty. Or at least that's how it was when I was in the service. Has this law changed?
Add to this the fact that the government seems to want to renege on promises it made vets when they signed up (Changing veterans benefits) and all I can say is You have GOT to be kidding me!!!?
I do know this much though, as part of your contract it says you can not sue the government. (or at least is used to)
Edit: I see the officer angle was already covered. Oh well

You can still be called up if you're in the Inactive Ready Reserves. My commission was 5 years active duty 10 years Inactive Ready Reserves. And yes they tell all this before you signup.
