MS will either:

buy the rights for the name

pay off the CEO and get his permission

or have all of the Xbox technology people killed and take the name

I don't think Microsoft will pay these guys off. If they do the smart thing they'll let microsoft sell a few million of the units, then demand a royalty of all units sold as well as all games, periferals, etc, with the xbox name on it. This Xbox Technologies company is in an extremely fortuitous position right now. Lucky them.

Is Microsoft that dumb, you would think they'd know there was a company out there with the name Xbox before choosing it? I hope these guys don?t go to court with Microsoft; they would go bankrupt before winning.

I?m suspecting Microsoft would need to pay them a large amount of money before they?d consider giving up the name Xbox? Do a search on their name on any of the popular search engines and Xbox Technologies pops up all over the place. That tells me their name is no stranger in the tech world. I mean they?re even listed all over the place on Yahoo Finance etc.

Which ever of Microsoft's attorneys let the company pick a name that was registered by XBoxT, need to be fired. Heck, all they had to do is a web search, lol.

THIS EXACT SAME issue came up WAYYYYYY back when they released MS Excel.

You'll notice, that you'll NEVER see the word 'Excel' WITHOUT a 'Microsoft' or 'MS' before it. Another company had rights on the name 'Excel', so Microsofts' way around the issue was to tag the name with the MS/Microsoft prefix, case solved. Score Microsoft.

So, if this Xbox thing becomes an issue...You'll soon be seeing it called the 'MS Xbox' or 'Microsoft Xbox'.

I seem to remember that they had exactly the same problem with Internet Explorer. Some guy had been using the name for a while and along comes Bill and starts using it too. The guy got a nice payout (can't remember how much - $3M???).

X-Box is a stupid name anyway. It sounds like something you can use to look at porn...

Hey maybe they can call it MXB. If the company's name is XBOX, then why doesn't microsoft call theirs X-BOX. that's 2 different trademarks.

Or name it "The X BOX". You would think a multi billion dollar company would research something so simple like a trademark name before giving their product a name. How stupid!

I think Xbox Tech has no case. There are S**tloads of compaines that have the same name as some other company's product.

For example:
Sony Trinitorn VS Trinitron Wireless.
AMD Athlon VS Athlon Communications.
Pontiac Firebird Vs Firebird International.
3dfx Voodoo Vs Voodoo PC.
M&M's Mars Vs Mars Incorporated.

Funny, from what the article says, MS filed for it Oct 1999, you'd think the Xbox corp woulda jumped on it right away instead of finding out in 2000... but if i was the Xbox corp, i would just talk MS into a decent buyout to co-exist, i don't think anyone can win a legal battle against MS... too much money... ; P
