Ordered a Silencer from them. Got email next day saying item not in stock. Emailed them back right away to cancel. Didn't hear anything, assume they canceled but found out next day they already charged credit card instantly even item not in stock.

Wrote them, got response from Will,

"I was out of office did get your mails, item came in and shipped, too bad you didn't like it"

I ws like what the heck, that is worse than some of the FS trolls we have here! They charged my card without having the item in stock and now I get this kind of response after they force shipped on me.

I wrote them again, got email from Jason, the guy was basically blaming me for writing to the wrong email address. Ok maybe but NOWHERE in that email did it say AUTOMATED EMAIL DO NOT RESPOND! And he goes on to say I should read their terms or conditions because I am basically inept.

Let me get this straight, they charged my card when the item is OOS and shipped the item despite my cancellation now they are calling me dumb and won't refund my money.

Any advice how I should handle this?

1) Refuse shipment.
2) Contact CC company.

Problem solved.

But I don't really understand why you don't want the item. Looks like it just got delayed a day or two. You'll get the item you wanted at a price you found reasonable to begin with. I just don't see the problem.

They usually do a pre-charge sort of thing to make sure that you have enough funds on your CC before shipping the item. Lots of companies do it. Is there a restocking fee? If not just send it back.

Or like everyone else said:

Refuse Delivery
Call your credit card company

This is generally the solution to these types of problems.

1.) Open Box Carefully
2.) Shat in the Box
3.) Reseal Carefully
4.) Return to Sender

to the company's defence... I know of nobody who has had anything but the best of experiences with them... I've found them to be even less of a hassle with RMA's than even newegg. Sorry you're having so much trouble.

Are you insane? They have some of the highest prices on the net... their 'sales' are a joke.

That was pretty rude of them. If the item has shipped then you're pretty much all squared away, no? Chalk it up as a learning experience.

Go free ipod scam!

No, that's Xiety.

Absolutely correct way to handle this.

When demanding the refund, do not forget to remind them that a successful chargeback will be expensive to them (on average about $100), and that you have every likelihood of being successful.

Some companies really need to be reminded that proper service is just as important as product and price.

Refuse delivery and make sure you have copies of all correspondance and then contact your
credit card company and have the charges removed.

The problem with refusing shipment for many people is that it's not an option if it gets shipped to your company (ie receptionist signs for it) or your house (and you work, like most people).

A company does not have to have stock on an item before they charge your credit card. In fact many businesses run a just in time (JIT) inventory system that allows them to minimize or reduce carrying costs.

However, by charging your credit card they are legally obliged to sell you the product for the agreed price. They seemed to have met their obligation.

In terms of cancelling your order. Email is a difficult mechanism. There is no proof that they did or didn't receive the cancellation notice. It also depends on their return policy. If they had to purchase the item (to sell it to you), then they may have already committed their funds on your behalf. If you cancelled, then they may still have to buy the item.

PS - Why do you want to cancel to your order anyway? They shipped the item for the same price you bought it for right? What's changed?

I assumed it was in stocks and I will get it no later than 7-31. BUt they told me they won't ship until 8-4-04 at least. That is why. 4 days is too long not to use my computer as my original Vid Card fan was fried.

Sounds like you screwed up, gave them a hard time about it and now you're mad because they aren't bending over and absorbing the cost of your screw up.
