I was in a crash just two hours ago. Minimal damage, although I question the legal accountability of causing an accident in this state/town.

I was going straight when this van from oncoming lanes makes an illegal left turn in front of me cutting me off and goes into Blockbuster parking lot causing me to slam on my brakes. The driver behind me couldn't stop in time and she bumps into me.

While we were exchanging insurance information, the van driver who made the left turn notices what he's caused, goes out the other driveway and takes off.

I called the police and requested someone on the scene. I told them about the driver who caused the collision, yet I was just told "State of Oregon is a non-fault state and the police can't determine fault. You will have to let your insurance company investigate it".

WTF?!!?!?!?! Whatever happened to accountability for doing a illegal maneuver causing other people to get into an accident?

Man, people just can't make left turns nowadays.

I bet they just didn't wanna dispatch any units to find the car.

We were just in that area today.

That's next to the Round Table Pizza, right?

Better question is, what do I do now?
I ran after the jackass and got a snapshot of his car, but I'm not sure if his license plate is captured. If it is captured, what do I do with it?

Did the girl who rear-ended you see him turn too? If so, I guess you've got a witness. You could call your insurance agency and ask what your options are.

Or would a witness have to be unrelated to the accident... hmm...

So even if you gave the plate number to the cops, they couldn't issue him with reckless driving?

Oregon sucks...

You give it to the police, who will laugh at you and throw it in the trash.

At most they will go the the guy who caused the accident, he will tell them that he was just minding his own business and that he was well clear of the road when the accident occured.

Get any witness info you can, at least their contact details.

Call the DMV on Monday 503-299-9999 with the other persons license plate #

I really don't want to involve insurance. They're just going to use it as an excuse to add "accident" to my record.

Once I have the photo developed and if it shows picture, I think I'm gonna pay a visit to the precinct that's in charge of the area.

Nothing. Forget about the van, and make sure you get your loss covered by the driver who rear-ended you.

You were rear-ended. You won't be found at fault, regardless of whether or not you hit your brakes.

Work it out w/ the insurance companies (hopefully mostly with hers).

The loss? a quarter sized scrape spot on the bumper. If I try to get anything from the one who hit me, she'll try to claim she wasn't at fault and it's the third car's responsbility blah blah blah and I just don't want to deal with the hassle.

Some insurance company will put "accident" on your record nonetheless and find you at fault for being on the road.

You can post the picture online if the license plate showed up but isn't clear, maybe we can help make it easier to read.

If you can't read it, maybe you should just talk with the person that hit your from behind

Ok, here's a pic.
bumper.jpg

Scraped paint, quarter size
some scuff marks that will probably buff out
damage to bumper sticker

So, obviously its not about getting reimbursed. It's about making sure the jackass doesn't go his merry way without hearing anything about it.

The pic of the guy who took off, I'll have to get the film developed...

At the very least, I would say that the paint has probably been stressed (look for little thin lines running across the bumper). That means it's going to chip off. Maybe not any time soon, but eventually. I still say deal with her insurance company, who should have to pay for all of it. It's not your responsibility to track down the driver of the car that cut you off. If her insurance company wants to pursue it, then that's their business.

Anyway, since you're an OSU/Bush/Cheney fan I won't try to convince you to do the right thing beyond this post.

Good luck either way.

Illegal maneuver or not, he is not the cause of the accident.

The cause of the accident is the person following too close behind you.

Yep, you should be able to stop before hitting the car in front of you. In this case she couldn't and it's her fault. HAd you have hit the van, then you'd need to start looking for him/her.

She can try to claim anything she wants, but she was at fault in the accident.

Correct the driver behind you is at fault. She did not have her car under control..
