YAEbayT: Bought fake wii nunchuk, was listed as official

So I recently bought a few wii nunchuks off an ebay auction that stated were 100% official. Well, when I got them and compared them to an official nunchuk I bought from Amazon, they weren't the same. Phillip screws (Nintendo uses triwing/Y), matte ish connector (other one is like a standard connector), etc.

So... what is the best way to going about getting a refund? Just follow the ebay Buyer Protection steps?

Yep, I would follow the Buyer protection steps. Also from now on, stop buying stuff from China and Hong Kong, it's all pirated/counterfeit stuff.

It was from Hong Kong and was $5.30 shipped? That should have been two immediate red flags.

You'll have to contact the buyer and if that fails, file a dispute on your item. If eBay determines the dispute to go in your favor, you'll win whatever condition you selected when you start the dispute (refund).

Yes, the auction states "official" but come on ... for $5.30?

BTW ... do they work? If so consider yourself fortunate.

Who cares as long as it works? I've bought a few things from Hong Kong, they all work fine. If you have to look at the screws to see the difference, I'd say that's a pretty good deal.

price should have been a give away. however, the auction does say it's the japanese version. sounds unlikely, but you should look into that to be sure

Wait...wat?

Like buying a brand new gaming PC on ebay for $200 and it says it runs Crysis perfectly. That is the equivalent to what happened here. There are some things ebay is good for, things an AUCTION site makes sense for. Gaming hardware is not one of those things.

Oh I knew it must've been cheap for a reason. Since I needed some extra nunchuks, I thought why not given the price.

So, I received a response back from the seller. He stated that I've misunderstood and that the items are not original, but OEM. Is there really a difference between the two?

The "O" in "OEM" means "Original"

The auction states it's Nintendo branded, that trumps everything.

Even if you win a dispute against the seller you still have to send it back to the seller which I'm pretty sure would put you at a negative financially for the situation. I'd just not worry about, chalk it up to the gullible tax, and not buy from the seller.

An original equipment manufacturer, or OEM, manufactures products or components that are purchased by a company and retailed under that purchasing company's brand name.

OEM refers to the company that originally manufactured the product.

Example:

Company 1 produces widgets for Company 2.
Company 2 sells the widget under their more successful name.

Company 1 can sell the same widget as an OEM replacement for the item, since they built it.
Because it is not being sold under Company 2's more successful name, it will probably be cheaper, but will be identical (minus any branding)

The definition of OEM has always been pretty confusing and misunderstood by both sellers and buyers.
That might fly for the seller trying to use OEM as a misleading term, except for the fact that the listing said it was a "official Nintendo brand" controller.
(Not to mention the "100% satisfaction guarantee", LOL)

Yeah... the seller is saying that because of my misunderstanding, he's willing to give a partial refund (however much that is)... as long as he refunds the cost of the wii controllers, I'll be happy to eat shipping costs.

Won't the shipping costs be >$2.99 that you paid for the item?

(that is what will be refunded isn't it?)

I saw that... but I presumed that it would cost you more than that to post it back to HK... you may want to go to the Postal Office first and check what the rate would be.
