Check this out.

Guy wins my auction and pays two days later. I ship his package the next day via USPS and provide him a tracking number. I don't hear anything from him for two weeks and then now I get an email from PayPal saying that the item is dispute and they put a hold on my funds. Here is how it goes....first message is at the bottom:


From PayPal: PayPal on 12/19/2006 11:50 PST
Buyer escalated this dispute to a Claim.

I no longer feel comfortable communicating with the seller based on their response to my legitimate request for help. The seller indicated that the item was shipped. The tracking number the provided does indee show that the item was shipped however it has not yet been delivered more than 9 days afterward. Ibelieve, according to ebay and Paypal guidelines It is the seller's responsibility to address anny fullfillment or shipping issues not the buyer's responsibility. It is obvious that the package has bee lost or mirouted. therefore, I am requesting the refund of my Paypal payment.

This item was shipped. If you check the status of USPS tracking # XXXX it says:
Your item was processed and left our JERSEY CITY, NJ 07097 facility on December 10, 2006. Information, if available, is updated every evening. Please check again later.

Why it hasn't arrived, I don't know. Call the USPS customer service number and ask them. If you would have simply contacted me first before filing a complaint, I would have been more than happy to call for you. But since you went straight to filing a dispute, you can call.

Please remove this dispute or I will escalate it to PayPal.

Hello, i am getting VERY concerned. The USPS Parcel post tracking number you provided me shows that the package was sent from Georgia to Paramus, NJ in one day, however it has been over 10 days since the package arrived in Paramus but it was never delivered delivered to my Jackson, NJ address. I needed the xbox for a christmas present and it STILL has not arrived! Please look into this, Thank you. mike

It appears he's also filed another dispute with someone else who says they shipped his item to him.

Is this yet another eBay scam? Claim you don't receive an item and get your money refunded even though it was shipped out?

edit: Jeebus...just since this guy filed a claim and did my response, USPS updated their tracking to this:

Your item was processed and left our PHILADELPHIA, PA 19919 facility on December 19, 2006. Information, if available, is updated every evening. Please check again later.

So it went from NJ to Philly...9 days later...and the delivery address is in Jackson, NJ? WTF

Pull your money from paypal. If your tracking number doesn't show it as delivered, go ask USPS where it is!

I'm sure he's taking advantage of the fact that your only proof is the delivery confirmation number, which doesn't show that the item was delivered. Did you offer insurance in your auction?

Meanwhile, the seller can either wait with his funds locked, or give in an refund the buyer's money. Sounds like a great scam to me.

Did you use Signature Confirmation, as outlined in PayPals guidelines?
Seems like that is a common error.
Scammers feed off of this oversight!

But that should help you get Paypal to unlock your account, since it isn't lost.

That's how I got scammed not long ago. Buyer received the item, even confirmed to me in email that he had received it. Then he filed a complaint with PP saying he had never gotten the item, so they pulled the money from my account. I passed on the tracking information, his emails confirming he'd received the item, basically showed information to refute his claim.

PP ackowledged any communication, and disregarded my evidence -- basically they were complicit with the guy stealing from me. I hope your situation works out better, but Paypal are cast-iron jerks when it comes to this sort of thing.

Yep...Xbox360. Funny part about it is, I bought it Microcenter for an Aunt. Right after I cut the UPC off the box and mail-in the rebate, she calls my wife and tells me that her daughter doesn't want a 360 anymore. No way I can return it with the UPC missing so I list it on eBay instead....figured I can make a little extra cash since I got it for $200 after two $100 rebates. Should have went with my first instinct and put it in the kids playroom to be a media extender.

Yeah, unfortunately this probably isn't going to turn out in your favor.

Any valued @ over $250.00 MUST have Signature Confirmation in order for it be fall under Paypal's "Seller Protection Policy". Since you didn't follow Paypal's policy they will now have a legitimate reason to return the money back to the buyer.

Advice for the future:
1. If shipping with USPS always ship Priority Mail. Parcel Post is too unreliable. In my ebay auctions I set a fixed shipping price and make Priority Mail mandatory.
2. Follow Paypal's policies. (such as the SC for > $250)
3. If you don't mind losing money don't worry about insurance. If you do mind losing money then purchase insurance. Again, I make it mandatory for high-dollar items, a good example being a 360.

I'll keep that in mind in the future but I'll take them to small claims court if I have to. This ass isn't getting my money. If a tracking number was updated the same day this dude filed his dispute showing that the package was still en route, that means his dispute was unwarranted.

Who would you take to small claims? Taking someone who lives outside your state to small claims is damn near impossible.

that's why u pull your money from paypal as soon as it clears. otherwise paypal can freeze it. i had the same crap happen to me. luckily i got my money on the end.

small claims is worthless dude, u'll end up spending more money & time & get zero in return. way to go court system!
