Give her a time limit or else she'll keep dicking you around.

This. You've basically been storing her crap for her for several months. The money is yours, so as far as I'm concerned, the only real issue is how much longer you store her crap before you sell it or throw it away.

She made a bad decision buying those items on such a limited income, not to mention she had no way of moving them.

You are completely in the right keeping the money. Hell, since she's living on disability, part of the $125 was your money anyway.

you'd be justified keeping the money and telling the woman that the items are hers to pick up whenever she wants to... but that's kind of a douche move.

if it were me, I'd take my lumps, return the money to her, and attempt to resell the items on craigslist. but I'd rather be nice than right.

Yep

I was thinking of telling her that we could try to sell both items again (through Craig's List or maybe a friend's yard sale), and if we can sell them for the same price, we can send her the money.

This is a great compromise for both parties I believe. You get the $ the original buyer promised, and the original buyer (hopefully) gets her $ back. The bad thing is you have to sell it twice. Maybe you can try selling it for more than $125. Since 'a lot' of people were interested in it at that price, you may be able ot get more for it.

check can't be stopped 2 weeks after it's been cashed.

actually i seem to remember reading a thread where a company canceled a check even though its been cashed. they just took the money out of the guys account.

though it was a while ago and i can be insane.

hmm i swear someone h ere posted that a place put a stop payment on a check he cased 5 months latter. but everything i find says its not possible (wich would make sense) but man i am sure i remember reading t he thread!

Personally, I'd refund her the money and try to sell it again. My decision to do this would have nothing to do with the ethics of the situation, because my ethical views on issues like this generally go out the window when I know I am legally in the clear. I would refund the money because stupid people can make life very unpleasant for those around them when they know where you live.

I read that thread too, it was an insurance claim I think, that they canceled but said they would reissue later for some strange reason.

But this is ATOT so just because someone posted about it happening doesn't mean it really did.

what does beign on disability have to do with it? it does not mean you are poor it just means you can't work. from what i remember reading it does not limit how much assets and such you have.

"In her letter, she states that she lives on disability ($800 a month) and can't afford to lose the $125."

so true...
too bad you can't have a yard sale at your P.O. box...

by the way, the solution is to charge her a restocking fee for your troubles of having to re-post your items for sale and storage...so give her 100 bucks back and keep 25...or more...
